The One Plan on 3 is it false advertising?

Just signed up to The One Plan on 3 with their "all-you-can-eat" data plan, which is repeated in their terms as "all-you-can-eat" when other plans specify an amount of data you have to use, and 6 months free Spotify.

Found out today that the plan actually only includes 1GB of data and to use the free Spotify voucher I am required to purchase an Internet Max Add-on for £5.11 per month.

I cannot find any where on their website obout a fair use policy or even anywhere that specifies only 1GB of actual usage. :mad:

Been discussed many times. The ASA say unlimited can be subject to limits as long as it's on the same poster (usually in the small print). The usual response is that as most people don;t use the full allowance then it's unlimited from that point of view.

Odd, seems wrong but the ASA have ruled on it many times and always say that it's permitted in adverts.

Where did you find out about the 1gb limit? It sounds a bit suspect to me as I have a 1gb limit on my contract with Three but it is stipulated as such not "unlimited". They've made a big thing of this "all you can eat" clause so I'd be surprised if it isn't as stated. Also, Three were the first to drop the use of "unlimited" when advertising plans, for the sake of "clarity". Given this, I'd be very surprised if they started using the term again if they actually don't mean it.

I'm on the One plan with an Iphone4 contract and the plan allows me to use as much as I want data including tethering however it does not include 6 months free spotify.

Just looked at the 3 web site the one plan does not offer 6 months free spotify not even with the one plan sim only deals.

So I a bit confused by op's rant.

Yep I wrote to them once when Orange was adverting 30mb!!!as unlimited and got that very same response.

Three have made a big fuss about the fact that they now state the amount of data allowed if you have a limit and that therefore 'all-you-can-eat' really is unlimited, including tethering allowed. Their blog is full of people querying this and they have acknowledged that supposedly the information is just slow to be updated everywhere (e.g. not even all their reps know it).
So you should have unlimited data, but maybe the Spotify thing was conceived before this? If Spotify is free (I don't know much about it) the problem is irrelevant?

I thought Three changed the One Plan in December to be truely unlimited, all over plans by Three have a 500mb or 1GB cap.

Ignore the 1GB part. This is only because there are some changes still needed to be done on their systems which shows data use.

I write for coolsmartphone and had been told about this deal the day before the change happened and am in contact with their press team on a daily basis.

The data is UNLIMITED (sorry... All you can eat). If you check the 3 blog on blog.three.com you can see many people asking about the 1GB showing on their account and the team have explained the reason it shows this.

I know people who have used 10GB with no issues at all, you can even tether so use as a modem as much as you like!.

Ignore the 1GB, soon all the reference to 1GB will be taken off the site and your bill its just taking some time to sort everything out.

Yup, agree with those above. 3 only recently changed to "all-you-can-eat", so I'd guess they just haven't updated whatever you read. Also, Internet Max is the old name for their 1GB data plan, so perhaps the Spotify info is out of date too? I've found that parts of their website seem to be waaaay out of date.

All companies used to advertise UNLIMITED with a fair use policy in place. As I mentioned earlier the ASA say it's OK to say "all you can eat" with a set actual limit in place as long as its stated in the small print, and the mobile companies argument is most customers do not hit that limit so for them it really is all they can eat.

I know that seems backwards but no company can afford to give people completly unlimited data, there has to be a fair use policy inplace.
