Clamped for civil recovery.

  • Had they had a judgement then it could have been more difficult but clamping this way is illegal. It could be awkward at a small claim court even though you have right on your side the act of taking the P+ss would likely weigh against you. Suggest also post on pepipoo.com for other advice. Explain about the invoices and various letters.

Missed the bit about the Visa, suggest you try to get an incident number from police to assist the chargeback. You will have to be very persistent with them as they hate doing chargebacks even though they have to. You will probably have to escalate up the pecking order to get help.

Where would be the best place to get some info re chargebacks?
  • If i was clamped on private property could i grind the clamp off or do you think i would get into trouble??

I did ask that question and THAT would appear to be an issue the police WOULD be interested in as it may fall under criminal damage.

    Yes, it is Visa.

That's an advantage, it at least allows you to log a claim for a charge back. Contact your card issuer and see what they come back with. Make sure you tell them you had to pay under duress and to lessen any further expense!

Depending where you live as well some Trading standards are taking a keen interest in some clamper's, especially around the West Midlands area!

    Charge back. http://whatconsumer.co.uk/visa-debit-chargeback/
  • Although they were not interested its worth trying again to get an incident number.

And when they refused to show you their SIA badge and it was not clearly visible, it did actually become a criminal offence!;)
