What are the laws??

Hi everyone I have a question no one seems to know the answer to, could anyone tell me if it is law that if your car is sorned and garaged it must have insurance?
Even if it is not expected to be on the road again for a couple of years or so as Ive just got myself a mobility car, I want to take the time on my old rover whilst its off the road to fix it as a bit of a hobby.

I don't know what the law is, but when I got my renewal quote for my car insurance, there was a line in there that in 2011 it would become a legal requirement to have continual insurance, so maybe there is something coming in.

At the moment you don't need insurance, is it something worth insuring?

This was discussed on another thread sometime recently.

    Here it is https://forums.moneysavingexpert.com/discussion/2970300

No, you don't need insurance but for peace of mind TPFT would be worth considering.

    You won't need insurance.
The law will be changing soon though, but won't affect what you want to do.
If the car is kept off road, at the moment you can keep it taxed, while it's not insured.
Shortly, (maybe April from rumours) if the car is uninsured, it will also have to be sorned.
So your project car will be ok, uninsured, and sorned.

No law has been brought into force yet. The proposal is that cars must have insurance unless you've declared them off road. This is kind of irritating, I don't see how it'll tackle uninsured driving or increase road safety - police and ANPR can tell if you're insured just as easily as they can tell if you've got road tax / SORN.

Technically it's the other way round. If the car has no insurance you must surrender the tax and sorn it. If the car has been off road since 1998, and never been declared sorn or taxed, such as an old project, there is no need to insure it now, or declare sorn, it can stay undeclared and un-insured.
  • HI, I HAVE JUST READ THAT THE LAW WILL BE CHANGED FROM MARCH 2011 REGARDING THE CONTINUAL INSURANCE OF CARS.

However, it has been stated that the car will be seized from your drive if you fail to insure it and ignore the £100 fixed penalty notice issued (reduced to £50 if paid early)

    Questions :

    1. What if the car is being worked on - ie. no engine in etc. and therefore not roadworthy anyway ?

    2. Has your property (drive and GARAGE !!) now become the 'public highway' ?

    3. If so, are the council liable for the upkeep of the drive etc ? And if that is the case when I am having my patio relayed, will the council send the lads around (at their own expense) to put down said flags ?

    4. Will the laws of ownership be changed to now say that my property ends at the front door and the walls of my house not the 1/2 acre I actually own ? And will the council reimburse me for the land that I now own, at the going rate, of course ?

    5. If I slip on the step of my house, can I sue the council for not clearing the path in a safe manner ?

    6. What about the laws of trespass ?

    7. If the drains collapse under my drive - who pays to have them fixed ? As now my property, as from March this year, will become part of the highway ?

I think some sharp lawyer is going to have a field day with this stupid law - and rightly so ?

It should be fun to see how many claims under the 'no win no fee rule' are taken up due to the above.

What a big brother state this country has become.... And we all sat by and watched it ........

Have a great day before someone louses it up for you !
  • I got my tax renewal in yesterday and it does say on it that it is an offence to own a vehicle and not have insurance on it. I'll go dig it out now to see what it says exactly
