not yet. he is paying our mortgage and keeping a roof over our heads and once we've worked something out with regards to custody, he will buy our babies clothes/food/toys etc to be kept at his home when our child is staying with him.0 -

i would go to the divorce/relationship section for advice on this.
Peoples/partners priorities change over time. This may be you ex-partners intention at the moment, it may not be at a later date.0 -
thanks for the advice so far.
if i ring the tax credits and ask them to stop paying me my ex's small amount of WTC, can i then apply for income support straight away? once i'm qualified in the summer and i become self employed, is it easy enough to move from income support to WTC?0 -
hi,
First sorry your are in this situation. Be strong.
You can apply for tax credits in advance and then if you start working 16 hours it can be back dated. As credits are paid in arrears it will be based on your income last year. TAx credits help line 0845 300 3900.I think you should be eligible for Income support until then as you have a child under school age. If you receive maintenance from your ex, it will be deducted from your benefit I think. I dont know about your accommodation situation though, if that counts as maintenance.
Hope this helps0 -

But what will he be paying you for the child's maintenance? This won't affect any means tested benefits you receive, by the way.0 -

You must close your joint claim immediately and make a separate single claim. At present there are going to be arrears accruing.0 -

Maintenance is disregarded when assessing means tested benefits
Edit - have you claimed the single person's council tax discount?I'm a retired employment solicitor. Hopefully some of my comments might be useful, but they are only my opinion and not intended as legal advice.0 -

nothing has been sorted yet, the plan is for him to pay the mortgage and council tax and to buy our child clothes, toys etc... when he has his days of custody (2 days per week, we've agreed on)
to be honest, i know i'll sound bitter but i don't want anything from him other than the mortgage being paid. i don't want to need him in any way, shape or form after what he's done to our family. of course i know that it's his responsibility though and not the tax payers.0 -

i'm not sure i can, the mortgage is in his name, even though he isn't living here anymore?0
