recently received a letter from CapQuest after my CCA request stating that
"...we would confirm that your account is on hold for 28 days whilst we obtain the information required..."
do CapQuest make up their own rules to suit any occasion?
Presumably, I still have to have the SD set aside?"happiness is...positive cashflow!":j0 -

Agreed. The threats are more than likely empty.
However, normally best to treat them otherwise just in case.
Quite a few people have successfully claimed costs aginst DCAs using this tactic, so may be worth a hunt for those. Can't remember if there are any specific ones on here, but I think there are a fair few on CAG and legalbeagles.Free/impartial debt advice: National Debtline | StepChange Debt Charity | Find your local CAB

Have you tried contacting the person named on the SD??
If that person is not contactable, then it's an instant fail on the SD....;)Happiness, is a Kebab called Doner.....:heart2::heart2:0 -

a quick question regarding form 6.4 for the set aside. the layout has slightly changed since the last time I filled one in.
(a)insert name and address of person to attend hearing
Let (a)xxxxxxxx
attend before the Registrar as follows
on the old 6.4 form both the applicant and respondent had to be named in this space...whose name and address is to be stated in the new layout?
can anyone help pleae as I have to take paperwork to court first thing tomorrow as some unexpected family problems have occurred and I have to leave town for the next few weeks. this means I can't use the full 18 days to set this SD aside.
thanks everyone x"happiness is...positive cashflow!":j0 -
