Argos-Item not as described, what can I do?

    OP, I have found it on the Argos website, is it a Toshiba?

    There is only one listed for £349.99, and that is the Acer Aspire 5336.

    Edit: I've found two more ...

    This should be an easy one to sort - take the screenshots and ideally find the same page in their print catalogue. Take it to the manager. Say 'I bought this one because it has a DVD writer, but the description is wrong please can I have my money back, here's the machine in the box - thanks'. If that doesn't work (I'll be stunned!) Then the item is not fit for purpose, and you have every right to get very stroppy - if they won't refund on the spot, get their reason in writing and post it here.

    I think it is the Toshiba, as it mentions something very specific in Op's original post. I won't give it away, as I will get told off. ;)

    As others have also said above, with the misleading info you have to show them, you shouldn't really have an issue getting it sorted.

    ...it may have applied to the Tosh. 2 weeks ago...could it be different now?

    Maybe the the OP will (at some point...tomorrow?) come back and say Argos gave them a full refund....thus vindicating their stance!

    OP, did you purchase the product online?
    (if your answer to that question is 'no', then no need to read further)

    I note that you ordered it on 27 December, but when did you receive the thing?

    Distance Selling Regulations allow you cancel the order up to seven working days after receiving the item. The seven working days start with the day after delivery.
    You can cancel for any reason and their T&Cs cannot override that.

    If you are still within those seven working days, i.e. it arrived on or after 3 January, I suggest you get that cancel email to them asap.

    What cancellation rights do consumers have?

    Where the DSRs give consumers the right to cancel an order, this right is unconditional and begins from the moment the contract is concluded. Unlike when buying from a shop, the first time that a consumer will typically have an opportunity to examine goods purchased by distance means is when they receive them. The DSRs give consumers who buy by distance means more rights than consumers who shop in person. When a distance consumer cancels a contract to which the cancellation provisions apply they are entitled to a refund of any money they have paid in relation to the contract even if the goods are not defective in any way.

    The time limits for cancellation are as follows.
    For goods:
    provided you give your consumer the required written information no later than the time the goods are delivered, their cancellation rights end seven working days after the day on which they received the goods
