Ebay Rudeness-please Help!

Morning all, please help me! Bought 2 items from same seller (leapster leapfrog games cars/scobby doo) paid straight away via paypal, no probs there.
The cars game was sent recorded delivery,signed for it, lovely, now wrapped up for xmas.
The scooby doo game was wrongly packaged up into a cella magnetic sticker making machine! I signed for it, not knowing that at the time as was expecting loads of stuff, opened it, emailed he had sent me wrong.
The rude email arrived back that keep it, your fault for signing, not going to do anything about it.
I emailed back that scooby doo I wanted and should have.
He emailed saying that he is holding 'scooby doo' to ransom, I have to send back the cella maker (it cost £5.64 to send) then he will send scooby.
My final email to him was no you send scooby with an enclosed chq for £5.64 and then everyone is happy, you get cella back, my son gets his game and I am not out of pocket. He says no.
What do I do now?!! xx

  • it's catch 22 really, you are trusting him to send scooby if you send cella back, and he is having to trust you to send cella back if he sends scooby - and on top of that you've asked him to send you the 5.64 first so in theory if you were not honest (not doubting that btw), you could end up with scooby, cella and 5.64 in your pocket - normally, if something if faulty, buyer pays to send it back to seller then seller refunds, I think you are going to have to go down this route - how much did scooby cost? If he has said cella its yours, could you not buy scooby again (sorry have no idea how much these things cost) then sell cella sticker machine on to try and recover some of your costs? Who at the moment is out of pocket? is scooby or cella the most expensive? ok, have just had a quick look on ebay, the cella is going for £19.99 plus post, and there is a scooby for 9.99 + 1.50 post - I think I would cut your losses, buy that scooby and whack cella on - make it clear in your feedback though you did not receive what you bought and seller basically said tough. (mind you, make sure scooby is not being sold by the same seller as you have bought from!!), hth. x

    scooby doo was £12, well £10 and £2 postage. I have feedback over 1,500. Thanks for the info on cella, shall I put it on ebay then?

  • I would, if he's going to be awkward and it's going to cost you £6 to get scooby, (ie your return postage), it's probably not the best way of doing it as really seller should sort it out, but it's a way of breaking even, if I were you, I would either put it on at £18.99 or reduce the post from the other item a bit - double check the cellos on there though, I really only did a quick look whilst I was replying to you!! the magnet and sticker was was on one of the ebay shops. hope you get it sorted - it looks really good mind!! (and off she goes thinking can she afford it for dd xmas! lol) x

    I bought a Magnetic Cella for my son for christmas and its £18.99, keep it seller lost out, we all make mistakes its how you recitife it that counts
  • Go though PayPal. And claim the money back.

  • Absolutely, claim via Paypal - item not received. If he says that he can prove you have received it (i.e. because you signed for a package) you at least have the emails from him to prove that he has acknowledged not sending the (actual) item you ordered.

    File a claim but put that is significantly not as described or wrong item... Paypal wont let the seller use the excuse that you had signed for it thats rubbish! Impossible unless you have x-ray vision!!! lol

    If the seller doesnt respond to the claim in 10 days you automatically win too. If there isnt enough money in his paypal they take it off him everytime money clears and they put it into your account.

    Yeah but wont the seller say that they have offered to sort it out but only once the item has been returned? If paypal dispute is followed then that is what paypal will ask for anyway!

    Personally I would sent the item back by trackable means and they request a refund - you then dont have the item, if for any reason he wont refund go through paypal then
