    well i'm willing to take this down the Small Claims Route anyway, have already made it clear to them I will only settle for Refund plus costs and expenses if I do have to start proceedings.

    The trading standards Officer, Steve Playle, wrote an article for the Guardian last year on his experiences of taking Carphone Warehouse to court. It makes interesting reading. Actually it was 2009, the article is here

    Just to let you know I have filled in and entered the Small Claims Forms on Moneyclaim today.

    UPDATE

    Put in Court papers on 13th January (effective service on 18th), and as expected they acknowledges and said they would defend on the 31st Jan.

    I receved a copy of their acknowledgement on 2nd Feb, giving them until the 15th to enter defence.

    Imagine my surprise when on 3rd Feb I received a letter for the solicitor acting for mobiles.co.uk offering me the full amount of the claim plus costs in ful and final settlement. They "obviously" deny all liability and are purely making the payment out of the goodness of their shiny little corporate hearts. So I guess they don't want to defend after all....:)

    But what do I care I just want my refund. Now I just have to wait for the money to arrive.

    I wonder if all these costs awarded against them has been the reason why Mobiles.co.uk have reduced the cashback rate on TCB??

    Unexpected Update

    Thought all this was done with.

    Have received and banked the money that mobiles.co.uk sent me in return for me sending the faulty handset back to them...did that all alst week, wrote to the court ceasing the case; even got a recipt letter back from their solicitor confirming reciept of the handset, and of course I send the package tracked so I know they got it.

    Was a bit surprised to get a knock on the door from DHL this morning...mainly because I haven't ordered anything.

    Opened the package and found the handset I sent back to mobiles.co.uk last week, along with a note saying they do not accept returns if goods are sent back outside of 7 days from original delivery to customer.

    So these technically aren't unsolicited goods, and I have already returned them once to mobiles.co.uk.

    So am I now within my rights to keep the handset? OK so it's faulty but I could possibly trade it in for £20 cash even with the fault. ;)
