It comes as no surprise however because I did point out earlier in the year that it was all being re-organised.

I think you are right, their terms and conditions appear to be built around the Unfair Contracts Regulations.
I suspect that, as most of their business is contract-linked, the CS rep is not trained in the SOGA and that they will offer settlement before it gets to court when the legal team get involved.

mobiles.co.uk have replied to my Notice before Action email with continued offers of replacement only.
As they have not accepted my statutory rights in this reply can I now go straight to legal action without waiting for the end of the notice perod (18th Jan), it is obvious that the CS drones will not or can not give me a refund.

Unfortunately as my colleague stated, our terms and conditions state that there is a 7 day returns period and outside of that timeframe we will organise an exchange within 28 days. Although you are outside of the 28 day exchange period, as a goodwill gesture we will process an exchange for you.
Alternatively you can take the handset to any Carphone Warehouse store and they can organise a repair or a replacment handset for you if you take your invoice or confirmation email and a proof of identity.

As you gave them to the 18th to respond, they have now responded so you can go ahead without waiting.
It won't get to court though as they will settle just before, they always do

Actually they don't always settle, I had to take comet to court last year and they appeared at court....and lost, they got a right bollocking from the judge0 -

Silk is providing CPW's usual practice, and in this case, their lawyers will know they are on a hiding to nothing - as long as the facts are exactly as posted.0 -
