Hello I wonder if anyone can advise as I have a dilemma.
I have comprehensive car insurance.
My MOT expired on 4th January and I booked my car in at the Garage for an MOT on the 10th January because this is the only date the Garage I use had.
Sods law, on 8th January I was involved in an accident which appears to be uneconomical to repair and im certain my car will be written off.
The accident did not involve third parties and basically happen because it was wet conditions and the car was aquaplaning and i was unable to bring it into control hitting a barrier.
The car is fully serviced and i have the service history and I had also changed 2 tyres to brand new ones in December. I can prove this with the documents I have.
Will the insurance refuse to pay out my claim due to an expired MOT?
Please advise :-(

Unfortunately theres a good chance they wont pay out. They will say that the car is not road legal, which one of your requirements being a policy holder is to ensure it is.
You could explain to them that the conditions prevented you from getting to the MOT centre and see what they say.
Most insures look for ways not to pay. And when most things are on the DVLA database it wouldnt take much for them to check.
I hope they sort it out for you though, never know they might do well by you.
If you dont mind me asking how much is the car worth??0 -

I expect they will payout, but at a reduced level, cars without an MOT are worth less than those with.0

ryanm198 - The car is work £5000 according to Parkers Guide (dealer price). The Police attended the accident and did a check on me and said everything was fine (both car check and Breathalyzer)
mx5huggy - even if i have serviced the car only 3 months before?0 -
Ah was just wondering if it wasn't worth that much wouldnt be much point in claiming. But £5000 is a lot.
I hope ive been proved wrong by the other guys on here and they pay out but i always thought that no MOT = Not roadworthy.
They won't really care about service history.0 -
We had this a few years ago, we had actually managed to forget about the MOT. They deducted £450 from the final payout. This was about 19 years ago and the car was worth about £4000 or so. Sorry, can't remember any closer details - I don't drive so had little to do with it!What is this life if, full of care, we have no time to stand and stare0

For the love of God. No MOT does not mean no pay out...there's numerous threads on here about it!0

Jane - 19 years back you could have obtained a backdated MOT cert!!
I just cant believe my MOT expired 4 days before. Its not even months or weeks.
Thanks for your responses. I just hope they do pay out and dont deduct too much.0 -
If you recently had two tyres replaced, I'd suggest that you should get the other two officially measured and their tread depths recorded. Your insurance company can't refuse to pay just because you had no MOT, but if you had two illegal tyres and crashed by aquaplaning, you may have a problem.0

dark_lady for your next car remember you can get it MOT'd anytime upto 30 days before it's due.0
