    gordikin - its just the wrong time of year and an easy oversight because of everything else. :(

    Dark_Lady, in that case you could have an extra MOT at a more suitable time, say April, and get them yearly from then. You do lose some months of MOT though.

    Not much help now... just pointing out that you are not stuck with a fixed yearly date.

    You obviously didn't drink in the right pub when you needed a "backdated" MOT cert 19 years ago!

    Why?

    The issue is that a car without a MOT is valued as being worth less than a car with one.

    That is never an issue.

    It's an urban myth. Not having an MOT does not invalidate an insurance policy!

    BTW, considering you can get a car MOT'd up to 28 days before the due date and the test expiry date is set as 12 months from expiry of the current MOT, why didn't you MOT it in December?

    Why not? Its an annual inspection. Do you also run around without insurance "because you can't believe it expired 4 days before?"

    Means nothing. I do 5000 miles in 3 months. The previous owner would've done nearly 7500 miles in 3 months.

    Some over entusiastic coppers may consider the Insurance as void at the side of the road, an impound the car. I suppose there is technically the issue that a car should be maintained properly as part of the T&C of insurance.

    But as other have said, they normally look at each circumstance in detail, for example bloke driving car that has had no MOT for years with bald tyres may not have their losses paid for but the 3rd party, if a 3rd party is involved would still get paid. The Insurance co might actually hold the policy holder liable and try to sue for their losses.

    However in the case of the OP, it was inadvisable to drive with an expired MOT unless en route to a prebooked MOT, it is one thing to have forgotten totally, but the OP, from their post, appears to have known it was expired and continued to drive.

    Which you can be fined for, no point s on the licence but I am sure there is a small fine.


    So even though the OP acted a bit foolishly in these circumstances I would expect a payout with a small retention of the settlement, obviously I think they would inspect the car to ensure there wasn't an issue with the car that would have caused a fail at MOT, and if a fault is found and this fault was deemed the cause of the accident then I think they may retain more of the settlement.

    But, as said by others there is no automatic refusal to pay out, each case is different. In the OP's position I think they will just hold back about 10%, remember the simple fact that if you bought a car at auction without an MOT then it would be valued a bit less than a car with a new MOT, even if you compared the exact same car. I have known some traders buy a car with an expired MOT, got it through a test and then put into another auction to see a small profit.


    The reciept to prove fitting two tyres and the service will be good evidence to prove the car was well maintained, but make sure it is an invoice from a proper VAT reg garage with hopefully proof on your bank or credit card statement of the date you paid for the tyres.

    Otherwise they may put two and two together and think the driver aquaplaned, but had new tyres on, which is less likely than the driver had two bald tyres on the car, aquaplaned then put on two new tyres and got a reciept made up to show a date before the accident.

    Not saying that is what happened, just being devils advocate, if however the condition of the tyres pre accident is deemed to be the cause of the crash then they may well try and reduce their liability.


    Lets not forget that the insurance company making a miniscule offer due to circumstances is different to your insurance being invalidated, they are entitled to ry and minimise their liability.
