Accident - MOT expired - advice please!

Last week I had an accident - my fault - in my husbands car. As I knew we were fully insured I wasn't concerned until I realised our MOT had expired 9 days previously. I had just bought car tax online so hadn't thought that the MOT could have run out as we usually buy it at the beginning of the month.
ANYHOW does anyone know where we stand now? There seems to be conflicting advice on whether we are insured, whether the insurance will pay out for the damage to our car or the car I hit.
Any advice appreciated.

  • Sorry to hear about your accident,but that is odd as you have to have a valid MOT in place as it shouldn't allow you to purchase the RFL online.

    I have a funny feeling knowing what insurance companies are like you wont be covered...fingers crossed I'm wrong.

    As far as i thought... (Almost guessing)... If you don't have MOT then your car isn't 'roadworthy' and so not insured..?

    Thanks for your reply - we bought the Tax online 2 weeks ago - MOT has expired since then.

    That's what I'm thinking too - just sitting tight at the moment and seeing what happens :/

    A vehicle can still be roadworthy without having a valid MOT.

    Check the details of your insurance policy. Not quite the same issue but Direct Line FAQs says:
    Am I still insured if my road tax has run out?

    Yes. However, it is an offence to use or permit your vehicle to be on the public highway, without valid insurance cover, valid road tax and a valid MOT (if applicable).

    Might be worth coming clean with your insurers and asking the question, if it's potentially an issue they would be checking it anyway. If your insurance is invalidated then it affects the other driver as well - he/she will have to claim on their own insurance as being hit by an uninsured driver.

    Yep, you'll be covered on both although if yours is a total loss you might get a slightly reduced payout to reflect the fact that a car without an MOT is worth less than one with.

    All assumes that the car is roadworthy or if it’s not then the unroadworthyness didn’t cause or contribute to the accident

    I've just read the 212 posts and now feel much more confident that my insurance company will pay out.

    I just wish people with OPINIONS and not FACTS would not put forward their opinions as facts! This can cause a lot of distress to others.

    I will keep the thread updated with what happens with the insurance company :)

    When you buy tax, the MOT required needs to be valid for the first day the tax comes into force (presumably Jan 1st if you bought it recently).
