Hi, a friend got a ticket for parking and did not pay it and now the bailiffs are involved. They came round to his house yesterday but he didnt answer the door. He has suggested that he "sells" the car to my hubby so that they cannot take it away as payment, and to send off the log book and inform dvla that the new owner is my other half. He was thinking of backdating the receipt to before yesterday. He parked in a bay that allowd him 20 minutes, he was there for 6 minutes in a van which he uses for work, dropping off a part to a customer. Should we help him out or will his debts follow us?? Thanks

I would imagine it all depends whether the car is legally is, or whether there is outstanding loan/finance on it.0

He owns the van outright,so no finance on it, will we be liable for the ticket and can the bailiffs take it if it is ours?And yes the lady in the avatar is me

Did he try the appeals procedure or did he get turned down?
The bailiffs are empowered to take personal possessions to pay the debt. If he doesn't have a car they can still take his TV, CD player etc.
Personally I wouldn't get involved because I'm not sure this is legal, and I wouldn't want to get taken to court. That's just my personal opinion and not professional legal advice.0 -
What he is suggesting is fraud. It's 'gratuitous alienation of goods.' Although they may not go to court, hubby could be an accomplice -especially if he does not actually give cash for the van.
I would be FURIOUS at so called 'mate' for asking you to help him break the law. How dare he!!!

I dont understand why he got a ticket??
You say he spent 6 mins in a bay that allowed 20mins?
If he received the ticket wrongly then he should appeal,
If he received the ticket rightly then he should have paid.
If i was you i would not go along with this at all, sounds like you could open a can of worms for yourself, to me.

If he received the ticket rightly or wrongly he would still have had to pay it, no choice.
Besides, whos to know he's our friend? We are not related and we live in different towns? The car has tax disc, mot and insurance, so in that respect its all above board.And yes the lady in the avatar is me

I'm not taking any moral high ground here but it basically constitues fraud and deception. Both offences can result in imprisonment. Is it really worth the hassle for the sake of a parking ticket?

If he was only parked for 6 minutes why didn't he appeal the ticket? When did this offence take place? I don't see what the point in backing dating the 'sale' by a day is? This offence must have happened months ago!
Also if your friend continues to drive the vehicle and gets any more tickets or even gets flashed speeding your husband will be liable!

No look like I said I'm not acting all moral here. But your friend is selling the car with the intention to not pay a fine which could be constituted as deception.
Even if he sells the car, ballifs can seize any other goods to the value of the fine.
What I'm saying about when he sells the car is that for the ballifs to be involved this ticket would have to have been issued months ago. Ballifs won't be involved until a long way down the line. I'm pretty sure you get 28 days to pay the fine by the council who issued the ticket so the offence happened a minimum of 28 days ago but more like 2 to 3 months if not longer. Thats why I don't see the point in 'registering' the car in a new name 24 hours earlier!
Your friend won't avoid paying the fine by 'selling' the car. Simple as. And as he is doing to avoid paying a fine he will get into more serious trouble. Why would you want to get involved in that?0
