The Blackberry was my 2nd choice. Now the handsets faulty Id like a bb.
I thought him an idiot because he wasn't helpful and took my phone number wrong 5 times and wouldn't give me a straight answer. Thats ur opinion if you think I am foolish for buying a phone I wanted. I wanted help not opinions
You actually wrote "Is this on, or have I got a case to get out of contract?". That invited an opinion.
Put that to one side, though. By reading through threads, you will see that you have little to no chance to getting your contract cancelled. However, the SOGA puts the onus on the supplier to prove that goods supplied within the first 6 months are of merchandisable quality and they have to repair any faults that prevent the handset from functioning properly.
If you are able to show that the handset in question suffers from generic faults that affect significant numbers, then you may be able to persuade supplier that it is in everyone's interests for you to have an alternative handset, thereby avoiding costs in sending back handset after handset which actually has a manufacturing/software problem.
But you have agreed a separate airtime contract with Orange and this forum is riddled with threads from MSE members who have handset problems on all networks and all seem to have failed to find the Holy Grail of being able to cancel their contracts on these grounds.
My point about waiting for initial results on new handsets from others to be posted is precisely to prevent you from experiencing this same problem next time.

I think the best you can expect is them to replace your handset, you can't expect a different phone entirely on the same deal - especially a BB because they need their own data tarriff anyway.
I have recently signed up with orange and the sales assistant made it very clear a couple of times before I added my signature that I couldn't change my mind. Once it's done it's done.
So if it's really a faulty phone, they should replace that but they're covered as far as signal goes. You can sign up to receive a t-mobile signal too which is free of charge but doubles your chances.0 -
When I used to be with Vodafone I had an ongoing 'struggle' with them over a phone and general network issues. After a few calls and getting nowhere, I told them that 'time was of the essence' and if they didn't come up with a suitable solution within 7 days of this final complaint, then I would cancel the contract as a contract is a two way agreement, and they weren't keeping their half of the deal.
I did then get my problems sorted and they sent out a network engineer to investigate local faults in my area.
All was sorted.
Now I can't say that my 'tactics' worked or whether they would have eventually sorted the problems anyway, but whichever, I was happy and everything then worked ok.0 -
I am happy to pay more or change the tariff to get a BB. I don't want one at the same price. But if the new deal offered for a BB, should I be able to renegotiate a contract is not competitive then I'd like to leave...
But I guess I'm not going 2 b able 2.
I hadnt really understood about the phone and orange being separate entities. It makes sense but I'd seen it as if Orange are willing to work with a manufacturer that have supplied a faulty handset theyve taken that risk and need to take responsibility. But I'll have to wait and see0 -
So...........get Orange to replace the faulty phone.
Buy the phone you want (CPW payg phones are unlocked).
Put your contract sim card into your new phone.
Sell the replaced faulty one to the highest bidder using the comparisons on here.
Ain't no way you're going to wriggle out of an Orange contract. I tried. 6 months into a contract my phone lost it's signal. Orange's answer was *your phone must be old* Err no, it's on contract only 6 months old. Next answer * you'll have to ring CS* with no signal? that'd be gifted Next one * stand outside the shop & do it, you should get a signal here* And i can do that every time i want to make a phone call?? :rotfl:

Its the 3 repalcement rule with orange
3 Replacements they'll offer an alternative handset. but its upto them what they offer, My friend works in the Orange technical department and its common people ring up with faults to get a better handset (hence they have this rule, not saying the OP is in wrong or done wrong) When this happend to me I had an Samsung Omnia, Got offered a iPhone 3GS a HTC Hero or a Nokia N95. Went for the iPhone!0 -

So turns out the guy @ Orange did misinform me...
The original guy said return the phone, we will call upon receipt to discuss new contract or cancel. The 2nd guy said this was nonsense, apparently not...
Guy called today to say I can stay or go up to me...
So I can choose 600 mins, unltd text/net £17p/m for bb curve, or same deal but £10 for phone and £22 p/m on a bb bold with orange ... or cancel and go to Tesco and have a bb curve on voda or O2; 500 mins unltd text 500mb net £100 tesco voucher and 1000 clubcard points.

Yeh right, Orange will never offer to swap your handset to an iPhone because it also means amending your contract to give you an iPhone tariff, and a Nokia N95? Did they just happen to have one laying about in a drawer that they wanted rid of? That phone is 3 years old
For the same reason they won't swap a faulty handset to a Blackberry as it means amending your contract or adding chargable Blackberry services0
