Orange and phone issue

Tenth Anniversary 500 Posts Combo Breaker
what can be done. partner took contract out in dec with orange with htc wildfire mobile.

she has been having loads of issues with phone, phone freezing, crashing, games not working, wifi not connecting and also she doesnt get any signal while at home.
also she is struggling to use the phone also.

what can be done, can orange do a new phone, cancel deal and move to new deal, can she upgrade phone or what?

    I am having a similar issue.
    I signed up for 24mth orange contract end of nov and phones faulty (doing same as u mention).
    I phoned 150 and said I was having the same probs uve mentioned and I want a Blackberry, as lost faith in this handset and its useless, don't want replacement, want a different handset.
    They said ok, send bk ur phone recorded delivery, and ul b called to renegotiate ur contract.
    Sent phone bk 30.12.10.

    Tesco's deals on balckberrys at the mo are pretty unbeatable so I thought I will not renegotiate but cancel and go with tesco.
    I went to orange shop today; they can't help.
    Phoned 150 and the prize idiot I spoke to was no help. He reckons i've been told a load of crap as I can't renegotiate 1 mth in or get a different handset just a replacement. If I want to leave I must pay the remainder of the contract (23 mths at £25 p/m!!)
    I want to leave orange now as I find the service I've had is awful, and as the handset is faulty and they can't provide a competitive enough deal on an alternative handset I don't see why I should pay to leave when they have not met my expectations. If I didnt pay my bill they'd kick off, why can they refuse to give me a new handset as opposed to a replacement and expect me to be ok with that??

    Is this on, or have I got a case to get out of contract?

    Moral of the story...don't be signing up for long comittments when it comes to mobile phones.

    If phone is faulty then a replacement or repair may be offered.

    That is about as good as it gets as the phone and airtime contract are two separate elements

    As Im only a month in tho they said they'd "renegotiate". Seems iv ebeen misinformed doesnt it.
    Looks like im stuck with the replacement crap phone rather than a new blackberry

    A new Blackberry should have been ordered initially if that was what was desired, all is not totally lost, you could sell the current handset and use the monies towards a sim free or same network Blackberry :j

    Not quite sure why a CS rep that tells you his company's t&c/policy is described as a "prize idiot" because he told you some information you didn't like.

    I agree with DUTR about signing 2 year deals that don't meet expectations and t&c or DSR rules that are pretty tight about cancelling contracts.

    Sale of Goods Act can help if a handset does not meet its functional requirements and is faulty.

    At the end of the day, prudent buyers should curb their enthusiasm for the latest phone and wait till the net has posted sufficient user experience about a particular handset to see if it is a lemon or not.

    I had a Motorolla flip out which has been returned.

    The Blackberry was my 2nd choice. Now the handsets faulty Id like a bb.
    I thought him an idiot because he wasn't helpful and took my phone number wrong 5 times and wouldn't give me a straight answer. Thats ur opinion if you think I am foolish for buying a phone I wanted. I wanted help not opinions
