    They will be committing an offence if they send it through the post as they know its fake.

    Send them back and get your refund, do you now want the games and the refund? sounds like it to me. So far it's only you who are saying they are fakes, maybe the seller disputes this. Either way you win and paypal have sided with you. Send them back, ask for your delivery costs and if he doesn't give you them a neg will hurt more than a couple of pound.

    I wouldn't send back, keep pushing they are fake and as mentioned it would be wrong to send them back.

    You need to keep them as evidence they are fake, you should be abale to get a full refund without sending them back, to which they should be handed over to trading standards (if they want them) or destroyed.

    The problem with this is that Ebay/Paypal require that the items are returned before refunding the buyer. Seems that the OP is either stuck with the games or returns the games to the seller for a refund - This may be illegal but without the signed proof then a refund will not be processed. :(

    You have to be very clear with paypal/ebay that the items are counterfeit and you are not sending them back, you will get a refund.

    To send them back for them to knowingly resell fakes is plain wrong.

    Firstly, you can only have one case open, Ebay or Paypal.

    If you have the Ebay case open, direct them (Ebay by phone) to their seller protection and specific wording on counterfeit items. It clearly shows the onus is on the seller to provide authenticity. Like Paypal, Ebay sometimes need to be reminded of their own rules.

    Give the items to trading standards with the seller's id. Ask them to confirm they are fake (or not) and notify you and paypal of the outcome. When I lost a case I still got a refund later doing this however I suspect it was a good will refund so no guarantees. Next time open an Ebay dispute.
  • Hi everyone. The person I spoke to from ebay clearly had no idea what she was talking about, I told her the items were counterfeit and I refused to return them as it is against the law, she said 'yes, but you have the items so you can't get a refund until you have returned them' I said to her, do you know it is against your policy to sell counterfeit goods and that it is also illegal, yet you are telling me to commit and offence by sending these games back. she had none of it and kept saying I had the items and needed to either a) send them back to get the refund or b) get signed documentation proving the items are fake. I said no thats not right, check your policies it is up to the seller to prove they are authentic.. she kept saying please hold while I check my notes so it was obvious I was getting nowhere.
    I was so furious I messaged the seller saying give me a refund now or I will get the documentation, receive my refund and then contact the police.
    Anyway, I got my refund and the games are in the bin.. Poor quality AND they didnt even work.
    Im so annoyed at ebay at the minute, it took me ages just to find their number to phone and then I kept getting beat around the bush by someone who obviously had no idea what she was talking about. At one point I asked for a supervisor or manager and she said they've all gone home its only me left, at that point all i could do was laugh.. poor service. thanks for everyones help
