Fake Nintendo DS games. Help

Hi, I bought 3 Nintendo DS games from Ebay, they've arrived and they're 100% fake, Yes they work but the printed images are so poor it's really obvious.. I didn't know they were'nt going to be genuine when I first bought them. I'm so miffed as I've watched the same items go for cheaper which will probably be genuine!
All I want to know is where I stand? What can I do? Obviously I want a refund but under what grounds do I do it? I thought it was against the law to sell the fake ones. Any help is welcome. Thanks

Not yet, no. I wanted to see where I stood first. I don't want to have to send them back for him to say 'they were never received' like they usually do.0

You should contact the seller first.
If you need to open a case for counterfeit items, do so in Ebay as the onus is on the seller to prove they are authentic. Usually you do not have to send them back.0 -
This happened to me with some kids DVDs. I contacted the seller with my concerns and asked where they had purchased them. No reply. So I reported to eBay and was refunded almost immediately no questions asked and I still have the DVDs (which do play fine, but are fake due to printing and the disc they are on).
I checked on the seller but they were no longer a registered user.0 -
Contact the seller and if no reply or a reply you aren't happy about open a dispute with eBay, not paypal, eBay make the seller of the item prove it's genuine where as Paypal will make you prove they are fake. HTHYou never know how strong you are until you have no other option.0

This happened to me too, just before Christmas with a DS game I bought for my daughter. I contacted the Seller who apologised and asked me to return the cartridge but not the box (cheeky!) to Hong Kong and then he would refund me in full.
I reported it to ebay but nothing happened. It was easier to get a refund via Paypal. Just start a Dispute and tick the box for "Fake Items". This got me a Paypal refund almost straight away and I didn't have to return the items to the Seller either.£2012 in 2012 Challenge £2051.06£2013 in 2013 Challenge £500 -
Ebay are useless at punishing fakes, chances are the same seller will have more on there right now! :mad: Also take care with the game, They are cr4p quality and knacker the insides of the console due to poor construction, There are loads on fleabay, you'd do better trying Amazon or game where they seem to actually care what buyers are getting0

There are loads of fake DS games coming from Turkey they even have stalls in the markets selling them as the copyright laws in Turkey are very lax or non existant. They sell perfume and aftershave as well and look very convincing and very cheap ie £5 a bottle.Lifes a !!!!! and then you marry one:D0

Have they changed the rules on fakes? Previously it was up to the buyer to get a declaration on headed notepaper from a genuine retailer that the item was fake, which is really hard to do!Should've = Should HAVE (not 'of')

Hi everyone, just an update (need some more advice)...
contacted the seller.. opened a dispute over ebay for a refund.
the seller has responded saying he will give a full refund of the games and P+P if i return them back to him.
where do i stand now? I dont want to return them (incase of a 'I didnt receive them' fiasco)
What can I do now?0
