Evidence isn't just the benefits - in a court you can prove residence with other factors. Like who takes him to the dentist or who took him to the doctors. I take my child to the dentist, but just because I do that, doesn't mean that my child lives with me - you need concrete proof. Your neighbour could take the child to the doctor, dentist etc but it doesn't mean anything!Plus the school will have records of the signed authorisations from school trips etc and legally have to keep these for 6 years. That doesn't prove residency either - either parent (provided they have PR) can sign these, it does not mean they live with the child.Plus they will be able to advise which parent went to parents evenings etc. So, if one parent is too busy to come, and the other does, does that mean that the other parent doesn't live with the child? None of these is evidence that the child lives with a particular parent.

There are lots of methods of proof of residence that can be taken into account - not just who's claiming the benefits.
But these hold the most weight and somebody's word against another's won't be enough.

It will be on balance of probability based on the evidence to hand.

The CSA will find it hard to discredit a school, council tax and other public records. If the CSA rebukes a sworn statement then the Perjury Act becomes a problem if the CSA is unable to provide evidence to the contrary.

I would have thought that the evidence to the contrary would be the fact of the child benefit being paid to someone else. So if you weigh up a sworn statement against an official government record of payments, wouldn't the child benefit come out on top and therefore justify disregarding a sworn statement? Also, how would council tax records show anything about a child? Isn't it only adults that are recorded on the council tax system, or am I wrong about that?

No you're right ;) children have nothing to do with council tax.

DX2, your profile says you have been going round these forums and done the above over 288 times in the last three weeks alone.

What is it you are trying to achieve?

Have a good read: http://en.wikipedia.org/wiki/Rumination_(psychology) Common occurring with those who become dependent on handouts for a living.

For somebody to spend so much time on an internet forum is one thing, but a forum that focusses entirely on state handouts is quite another.

If this is DX2s way of getting therapy then I suggest getting expert help. Thanking negative posts over & over again isnt going to work, it could even make the symptoms worse.

    Two4Tuesday,

I am going do that today. I am NOT after any money off her. I just want a clean start with NO ducking and diving.

As for the £10k, I have raised him and he will confirm that. I will try and get that wiped off "somehow" IF not, she can deal with it as she gets every benefit under the sun and has built up a little eggs nest of easy earned money. I am sure she can afford to pay it back!
Why didn't you tell them this for the last ten years?
The greater danger, for most of us, lies not in setting our aim too high and falling short; but in setting our aim too low and achieving our mark
