Reporting the Ex After 10 years, Advice Wanted.

Hi All,

I would like some advice on making a claim against my Ex-wife.

Hopefully, tomorrow I will be phoning the CSA to report that my son has lived with me for the past 9-10 years and she has been claiming all sorts. For the sake of a peaceful life I didnt not bother with this before now.

Ever since my son was born, I have supported him NOT just financially, I have supported him in every sense of the word, clothes, food, school trips and college.... basically, EVERYTHING.

The CSA have racked up a bill of £10,000 in back payments even though I have supported him from day one.

Now he is 19, the account is closed for interest and late fees and other CSA rubbish charges, bonuses and xmas boxes!
The original £10k stands. They are chasing me this amount.

I am at my wits end and have decided to stop hiding and come clean as its messing my life up.

    I moved out from home and after that they never got hold of me. I do not live where they think I do...

    I am NOT sure of what stage the situ is.

    You are phoning to "say he has lived with you for the past 9-10 years", but has he? Your wording seems deliberately ambiguous.

    Just playing devils advocate here...

  • I'm not sure what advice you are expecting. You are legally obliged to let the CSA know where you live. Surely if you have been supporting your son in the way you claim then you would have been better off letting the CSA know about it rather than hiding from them and accruing a 10K debt.

    My advice is to ring them up and tell them the truth.

    I am going do that today. I am NOT after any money off her. I just want a clean start with NO ducking and diving.

    As for the £10k, I have raised him and he will confirm that. I will try and get that wiped off "somehow" IF not, she can deal with it as she gets every benefit under the sun and has built up a little eggs nest of easy earned money. I am sure she can afford to pay it back!

    Please clarify - you notified the CSA at the time that your son moved in with you right? If not, then they won't backdate the case. As for benefit fraud, what proof do you have? If you have lots of proof and are willing to send it in to Income Support then you may get the case closed from a period backdated, but if they don't investigate, you have no chance at all.

    I didnt report the event as i had NO contact for years from them. It wasnt really in the forefront of my mind as I was emotionally supporting my son.
    As for the benefit fraud, my son has lived with me for years- I have never received a penny in child benefits or anything. The fact that he has lived with me should be enough for the benefit agency. His school, college have me as his next of kin with addresses.

    Ummm but it won't be.

    It's the first time I have heard of a parent NOT advising that a child was living with them - particularly if it was going to benefit them.

    It is really up to you to keep them informed - one quick call and your liability could have ended plus you could have been claiming the CB.

    The CSA won't be interested in you telling them that your ex has been claiming 'all sort's - unless it is CB in which case they will question why you didn't claim it.

    Keep us posted on what they say.
  • Get your DPA file and contact NACSA.

    One of your posts suggests that they didn't even have a confident address for you in which case there'll be no debt (maybe).

    But you're not very clear about the chronology and events so its pointless saying anything other then what's at the beginning of this post.
