Reporting the Ex After 10 years, Advice Wanted.

    Data Protection file, I have that. With NACSA, I joined them this afternoon. Just reading up on what they are saying.
    Have received a reply from my MP too.

    With a "confident address", they have NONE. Was living at mum's house until i moved in with my other half 8years ago.

    They never got hold of me after that bar the odd phone call.

    If you failed to claim child benefits, then there is not much proof that the child has been living with you - schools and doctors could hold both parents' details as next of kin and won't count for much. It will be your word against hers and as you haven't reported her or counter claimed against her I feel you will be on a hiding to nothing. You don't have a strong case to pursuade the benefits office to investigate, so the CSA won't do anything but chase you for arrears as you are in their eyes, the NRP.
  • Surfingus, it's pretty doubtful that they will wipe off any of your debts, as you didn't call them to let them know he lived with you, and actively avoided them by not notifying them of your change of address. The onus was on you to contact them.

    So, are you saying that your boy's mum has been claiming for your son whilst he was living with you? Who was getting the child benefit? I'm a bit confused :/

    Need evidence first - no evidence means nobody will look at it.
  • A Sworn statement is legal evidence in its own right.

    If a CSA official disregards such a statement without having any evidence to the contrary, then the official commits Perjury.

    It is his word against hers - what evidence does he have? He didn't claim the benefits, he didn't report her at the time - it can't be proven.
