    I agree that we never really thought we'd receive the items but I ever so I am appalled (sp?) at their customer service. Would it have been so hard to send out a blanket email & apology to all those affected to explain rather than just claim sold out?

    I have sent an email asking them to a) explain how the item can be sold out when they continue to sell it on their website and b) to close my account as I will never deal with them again.

    I realise they probably couldn't have sent us these items but it's the way they have dealt with it that has upset me.

    Anyway, do we have anywhere to stand with this as it was 'processed for 1st class post'? or is it down the drain now

    My own personal legal research leads me to believe there is no contract as it was never actaully dispatched (even though the computer system says it was).
    My research is from other legal websites.
    Mis-prices have been going on for decades and I'm relatively confident in saying that if there was a loophole then some clever MSE would have found it by now over the years or won a court case.
    I don't believe any court case has been won where the Ts&Cs say the contract is formed on despatch, so sadly I think they are covered.

    If you want to cost them money, then write them a complaint, they will have to spend time and money dealing with them, although after a while they may just send a standard letter.

    If this was a hacker's forum - there will be a DNS attack and their site would be down for at least a day!

    They get about 1.9m visitors a week so that's about 271,428 per day and at a typical conversion rate of about 2% at an average transaction value of about £50, that's 5428 orders per day and around £271,428 transaction value per day.

    A lot to lose.

    I don't have the Paris one but have the Spa, Supercar and Hot air balloon.
