            Mmmm, I came on here because I thought I would receive some sensible helpful advice, not to be treated like a moron. I was obviously wrong. As an Electrician who posts on DIY forums, if someone says they have no power to the lights I don't say, 'Its obviously your circuit fuse has blown you thicko', I suggest they check the fuse or breaker. It's obvious they didn't know to do that otherwise they wouldn't have asked. I simply wanted to know if I had any right to get a same spec replacement if the original was bought at half price. Somewhere amongst the sarcasm I gather I am not. Thank You.

            Why should they be better off and the store lose £250?
 They are not better off. The spent £250 for a tv worth £500, they are due an equivalent tv.
 So someone buys a Tv, it fails. It cost them £250. Say it's a £500 40 inch LCD, but they got a bargain. To buy another it would cost £500. The shop is under contract to supply a tv why should the OP be out of pocket because the store failed to provide a working one.
 There is such a thing as consequential loss and I think the OP should have a go at getting the tv sold to him.0

            While in Zippy's case, I can see the reason for suing for more - they (or their company) had made business commitments based on the price of the product's price.
 However, where OP is concerned, surely the SOGA covers this - either repair, replace or refund, whichever is most economical for the seller.
 However, OP also has a warranty... why go to any legal hassle when there's a warranty right there that will cover it? Hell, they'll probably get a replacement under warranty under such a short period of time.
 Where did you buy it from, OP and what make/model is it?0

            There is no consequential loss, as they haven't lost anything but the original TV (for which they've received a refund anyway). Consequential loss would be losing something further as a consequence of them not supplying a working TV.
 Either way, it's hardly relevant for a relatively small purchase cost.0

 When you buy something you enter in to a contract. It is not just the SOGA that applies, but contract law as well.
 Now where did we get to last time this question was popped. A pair of ballet shoes was the trinket in question, shop had none that poster wanted in stock. Shop offered to get some and tuck money for said. As far as we in the parish are aware, shop still has their money, but as for the shoes, one has to assume they are either on eBay, at a loss for the poster or still in the emporium.
 Where do we go here. Well, me thinks op still has not got their ds a telly and to think for about £15, btgof, games at the local toy shop.0

            I had a M&S TV 'go wrong' before and it turned out that after mains had disconnected an on/off rocker switch (at the rear of the back of thew set) needed to be pressed.
 I found this out after getting a replacement and reading the instructions. Probably lots of TVs had been returned for same issue.
 I'm not suggesting this is the case with your TV!0

 If you can't say anything constructive please don't feel the need to comment on my posts. We have successfully sued for consequential loss and it applies to all contracts.
 Probably would never get that far with this situation, but hey, it's only a discussion!0
