Buyer didn't pay!

Usually this kind of situation wouldn't bother me too much but the listing was for a pair of gig tickets which has now passed.
I contacted the buyer frequently, even by telephone, and was told every time that I would be paid.
I spoke to the buyer again earlier and he told me once again he would sort it out. He later sent me a message saying he still required me to send the tickets which I agreed to straight away. I still feel as though he's just trying to make excuses and drag it out until I no longer try and follow it up.
I've opened a dispute on eBay, even though I know the most I can hope for is not having to pay the fees.
I know that when you place a winning bid on eBay, you are entering into a legally binding contract but is there any way this can be enforced?

apart from the ebay process (which you've already started), you can go to small claims court (depending on value of tickets). Not as hard as you'd imagine - plenty of pro forma templates around online for this...0

I'd just complete the non paying bidder thing and move on, they will get a strike which can affect their future buying. I know its frustrating but best to just do the above and move along0

According to the buyers feedback, he bought (and paid for!) some more tickets for the same band but different venue 3 days after he won mine. So he'd obviously been online and ignored the messages I'd sent him.
EBay advised me to call the buyer, but if he doesn't pay by the time he said he will today, would it be okay to call again? I don't want to get to the point where he trys to say I'm harrassing him and then leaves me bad feedback!0 -
Are you saying you sent him the tickets, even tho he hadn't paid ?I try not to get too stressed out on the forum. I won't argue, i'll just leave a thread if you don't like what I say.

I would send him one last (polite) message saying that unless he pays by the time agreed today, you will have no other option but to take him to court for the money, as it would be unfair if you end up out of pocket given he made a binding commitment on ebay to buy the tickets.
If he doesn't pay, send him a recorded delivery letter in the post giving him 7 days from receipt of letter to pay the money, otherwise you will be starting court proceedings against him.

Yes the gig has taken place and the tickets are now worthless. The buyer ensured me he was going to pay when I told him if he didn't want them I could offer a second chance offer to the next highest bidder.
Will the court process cost me anything?

Not what you want to hear but just chalk it up to experience and move on. The moneyclaim online way of taking through the courts will cost you money upfront and no gtee of success, if chap is on the nat king cole too even if you do get a judgement, if he wont pay you're stuffed.
Not worth the hassle for a pair of tickets.
Frustrating though as obviously the buyer knew you couldn't resell them, some people just dont care.
Try and have a happy christmas regardless.

From his ebay name and the phone number I was given to call, the buyer owns a building contractors and seemed very 'I think I'm better than you' when I spoke to him on the phone. I politely asked if he was going to pay for the tickets as I was now out of pocket due to him and he seemed to talk down to me even though I'm not in the wrong!
The tickets originally cost me £110 and the auction ended on less than this so I'd already lost some money. I'm an NHS funded student so I already get less money to live on than most students so to lose that amount of money is very significant to me.0 -

Please don't misundertsand me, I'm 100% on your side just think it may not be worth all the hassle.
Think it costs about fifty quid (someone else will correct the amount Im sure) to file a claim, then all the time involved too.
If you had went to the gig you still would have spent the money IYSWIM so would still be in the same situation finacially (again, I'm 100% with you)
And it takes a few months...........
The decision is yours but I would at least try and forget about it until after xmas and just enjoy yourself.
