Is Vodafone in breach of contract?
Hi,
Heres my story:
I signed up online to vodafone with the Samsung Galaxy S 16GB, when i first recieved the mobile i noticed a few problems but when i searched the internet i was led to believe these problems were to be fixed when samsung release a software update.
anyways the update came out and things seemed ok for a while, however the problems came back, slow performance, gps problems, wifi, battery problems etc.
i contacted vodafone and they exchanged my mobile which has exacly the same problems, so i contacted them again and now they have sent me an 8GB version (as they no longer do the 16GB version) so my question, is vodafone in breach of contract because they cannot provide me with the mobile phone that i signed a contract with as this repacement phone does not "match the description" i signed up for and is "not fit for purpose" as it does not have the memory capacity as i signed up for.
Any ideas???

Timescale needed. When did you get original phone, 1st replacement and then 2nd? What did they say when they exchanged?
Certainly you have not got what you originally had, but if you are well into contract, then I would guess that the most you would get would be a few quid knocked off your rental.0 -
I signed up for the contract in august/september this year, i waited for the "big" update which has just been released over the last few weeks, i got my 2nd handset Fri 10th December 2010 (16gb version) - third exchange handset today (8gb version) they told me they would exchange the phone no problem , i also explained that it had to be the 16gb version.0

Well, they have accepted the phone had a fault - or should I say phones.
Speak nicely to a reasonable CS rep and explain that the 8Mb phone won't cut the mustard. Ask if they will replace it with a different type (if you see one you fancy) or ask them to make you an offer of either a line reduction or cancellation of contract.
Remember that being friendly and treating the person at the other end with respect will get you the maximum they can do to help and, if they say it's the best that they can do and you are not happy, ask politely if there is any way that you can get a better result.0 -

You have had three handsets all with the same problem and now the upgrade does not fix the problem .
So point that out to them if you are sure of your problem .
Though i must say i am running the same phone with no problems from day one .

the problem as far as i can see has only been with the 16gb versions that vodafone were promoting, i know someone who has the 8gb version and has absolutely no problems what so ever, everything works as it should. On paper this shud be 1 of they fastest phones available however in reality the 16gb version is extremely buggy either hardware/software. I have seen many people on forums complain of the lag issues the same as what im having and they are having to install 3rd party lag fixes but the principal of things, i should not have to install potentially harmful fixes to maybe fix the bugs.0

I'm not saying it applies in this case, but people really need to remember this. The person on the other end of the phone if paid to help and will end up out of a job if they don't at the very least try. No matter what you think of people who work in call centres show them some respect as if what you're wanting isn't in their power as long as it's a valid and a reasonable request they'll know who to speak to and they'll get to speak to them before you and in some cases instead of you and if you've not shown them any respect don't expect them to fight for you!
Edit: If they can't replace like for like who not ask for a microSD card that'll make up for the lack of internal storage (try for at least 16GB, but aim for 32GB

Was that tone or language really necessary zenmaster? I'm payin top dollar for my phone and I'd be pretty annoyed if I was having similar problems.I'm not bad at golf, I just get better value for money when I take more shots!0

I would be surprised if they offered you a replacement (all together another handset.. from galaxy to HTC say)
A friend of mine got the HTC Desire HD and the battery life is rubbish..
Apparently it needs to be charged almost twice a day!
(Yes, that cause of email / browsing all the time)
He was never offered a replacement phone..0 -
