Not that I'm suggesting this is the case but if he's saying he was away and his brother sent out the item he could also have been the one to have sent the emails.He is a fraudster as he said he photographed the item he sent you (later on he was not even there it was his brother)
The thing that stops me believing him at all is the way he has responded throughout though. As mentioned above, any genuine person would have dealt with the whole thing better.
Take the refund and leave it at that.0 -
This occurred to me too but tbh I didn't credit the seller with that much intelligence!Do you think it feasible - that the seller may have read this thread? I believe it is possible. From all that has been said the seller is probably a scammer. It must be tempting to take his gift, but I don't think one should. If you did take the gift - this story could twist and turn even more!

Please don't feel guilty! The scammer certainly won't be. The story about the brother playing a prank is a load of baloney IMO.

You had fairly a fairly unpleasant email from him at first regarding receiving only one piece. His tone changed dramatically once he was caught out.
It got clever scam written all over it to me.0 -
Regarding the seller sending you the package anyway - I would probably not accept it so that you can just close the matter. I would await Soolin's advice on that one as she will know the ins and outs of ebay/paypal liability for receiving it.
I completely agree that this sounds like a test scam. Dodgy dodgy. I don't know whether you sell on ebay but I would add them to your blocked bidders list too.House saving Targets:

I am so glad this issue is now resolved, it sounds to me like the Sel---Scammer got cold feet, I am guessing you were a testing ground but it backfired (nearly clever), I have no doubt he will scam again, once he has ironed out the rough spots to his plans, in the interests of any future potential victims, I would urge you to have NIL sympathy and make this clear in a NEG.
As others have said, I would urge caution on receiving any future parcels from this seller (whether or not for free).
Should you decide to take the free gift (as it is tempting) I would urge you keep all historical information and contacts you have had from this user, with preparation to show them to Paypal or Ebay as evidence (including the offer of a free gift) should they be needed as a result.
That he resolved this in the space of one evening (early hours at that) leads me to believe he knew only to well he had been caught out and panicked.

OP has their money back, so problem solved. No need to get excited.
If the seller wants to send the lego let them. They cannot chase for payment of goods they have sent which are unsolicited. They have offered them free of charge. End of story, if they tried to persue OP for payment they wouldn't have a leg to stand on.
OP can leave them neutral feedback stating there was a problem, but that seller made amends-this is stating the facts.
If seller really is the evil Lego scam-monger you've decided he/she is, they will soon get bad feedback and be found out, and that'll be that.0
