    Well an update for you:

Paypal have finally decided to cover me and have reimbursed the money!

Im so relieved, this has been going on since 24th November

However, im unsure what to do next.
I sent paypal all the details that parcelforce sent me, including all the delivery information & the signature of the person who signed for the xbox. They all match! The ebay user name, the address on paypal & the name who signed for it!
When these were sent to the CC company, they turned round and said the cardholder's chargeback was still valid! And the reason was unauthorized use!?
Do i go to the police? I have the address where the xbox was delivered, the persons signature etc, so surely that person was the one committing the fraud?? I also kept a record of the xbox's serial number.

    Thoughts?
It is pointless going to the police as no crime has been committed against you. I know that sounds hars but that's the reality. I tried to report an ebay seller to the police for fraud last month, paid £430 for a mobile phone which was never sent and then sold to someone else a few days later. Paypal were hopeless but when I tried reporting to the police they said they wouldn't even record it as a crime until I had written confirmation from paypal or ebay that my money wouldn't be refunded. Fortunately ebay investigated, found in our favour and the money was refunded. Paypal may choose to report the crime to the police as they are the ones at a loss

Personally, I would send a recorded delivery letter to the scumbag and tell them that you have reported them to the police for fraud, it might make you feel a bit better and give them a few sleepless nights.

Just be grateful that you've got your money back:T

Is it not also possible that if it were fraud, they could have set up a fake paypal account to use the card? If it were cloned/stolen i mean.

As for the signature, having their signature doesnt necessarily mean it was them who signed for it. My dads signature is the same as my own (names start with same first letter and obv surnames are the same), i could sign for a parcel using my own signature but they might think it were his. Also, i could sign mother teresa........doesnt make it true.

I know little of XBox (PS3 girl myself), but as you have the serial number can you not report them to Microsoft who may be able to ban them from XBox Live?

Yes they can. It effectively turns your lovely xbox into nothing more than a paperweight :rotfl:

Whether they would do it in this instance i'm not sure. Perhaps if the OP can provide proof of purchase along with a crime reference number they may.

Thanks, thought I hadn't dreamt that
