Sold ebay item, 5 months later buyer does a cc chargeback!

Right, here we go :(

I sold an xbox 360 S (new shape) on ebay back in July.
It was the buyers first transaction, but it went well with lots of email correspondence etc. I posted the item and it was received.

All of a sudden a couple of weeks ago out the blue, i get an email from Paypal saying the buyer has done a chargeback on her credit card, saying its an unauthorised transaction, which has taken £191 out my paypal account!!! How the hell can this happen after such a long period of time?!

Luckily, i never delete my emails and trawled through the sent messages to find the tracking number, which shows the item as having been delivered to the paypal address and signed for.

Paypal have had the tracking number for a couple of weeks, but so far i've heard nothing back.

So what now??? Im absoultely fuming :mad:

    Others may say different but I would phone paypal.

    Paypal (Dublin) - if you use - 0844 605 7777 first (planetnumbers) (1p a minute to dublin) then the paypal helpline no - 00353 1 436 9004

    At least you would have an idea on whats happening atm?

    I would also email the buyer and see if she has an explanation!

    I've phoned paypal this morning, but no joy, the guy in dublin just transfers me to the disputes department (US i think) who only tell me they are investigating :(

    I've tried getting the buyers contact details through ebay, but as the transaction was so long ago, it doesn't work.

    Looking at the buyers ebay page, she's never purchased anything since my xbox, to which i gave her a glowing positive feedback :mad:
  • I use Ebay a hell of a lot for selling as well as buying and I can tell you making contact when you have an issue is extremely difficult. I dont know of one person who has at some time not been ripped off with either a buyer or a seller.
    The only thing you can do is keep chipping away. Do not let it rest keep sending Emails and telephoning. One thing I must stress and this goes out to everyone and that is keep all correspondence. This goes for everything not just Ebay. Nowadays you have to act like a business whereby you keep every scrap of paper for at least 12 months.
    My parents were in business and the amount of paperwork they kept was staggering. You never know when you may just need it.

    Proving the item has been delivered may not help here, as the allegation appears to be that the account holder of the CC used to pay you claims the transaction was unauthorised.

    If you sent her the item do you still have a copy of her name and address?
    You could do a search for her phone no if she;s not ex directory - sorry thats as much as I can come up with - good luck.

    But am i not still under ebay/paypal's seller protection policy? I have proof that i posted the item to the address on the buyers paypal page?!

    Detail wise, the buyers ebay user name, & full name on the paypal account match, as does the email address. The POD was signed by the same person at the address sent to listed on the paypal payment page!

    So if the worst comes to the worst, i'll drive up there and get my xbox back (obviously i wont, its just angry talk);)

    Use the cruddy disputes process, then the complaints process and don't forget to make a complaint to the Financial Ombudsman Service.

    You are covered under the Seller Protection as you can prove it was delivered to the paypal registered address.

    Try posting on the ebay board, there are some very knowledgeable people over there :)

    If the dispute goes in their favour (which hopefully it will as they appear to have followed all the requirements for seller protection), what would be the basis of a complaint to the FOS?

    If a credit card holder informs their card issuer that a transaction was unauthorised and signs a declaration to that effect, then the card issuing company has no option but to attempt to reclaim the money from paypal.
    Following on, Paypal then have to investigate and ask the seller to prove that they sent the goods to the correct address and that the buyer received them.
    If they can provide this information then it is paypal who should hopefully take the loss.

    I always print and retain ebay, Paypal and Royal Mail (Proof of Posting minimum), documentation for 12 months. At least that way I have the information and a measure of proof at my fingertips.
