thats true if i decided to cancel but i havent, they havent provided the goods (or the means to use the service provided) and will not be able to so under the dsr they have to cancel the contract as if it had not be made and automatically cancel the credit agreement, is that not correct?
and the 72 hours time frame the dsr says that sellers arent allowed to give a max time frame?, iam confused0 -
72 hours is just what they want for returns - I recently had to return a faulty phone and the email said I had to do so within 72 hours. I got an exchange. That is where I got the 72 hours.
The 7 day period is the return policy for the retailer (almost all retailers now) - if you want to cancel the contract.
The sim card missing is unusual but have you checked all the packaging?
If you do not have a sim card and Orange cannot provide a new one - then your only option is to cancel the contract by returning the phone within 7 days.
Orange should be able to replace the sim card if you say lost (as someone else said) - I do not see why they won't. Maybe take it to an Orange store and ask.
If its an upgrade, why can't you use the existing sim card?

All you do is cancel and tell them to collect it.
The cost is down to them as it is not your fault the order is incomplete and you now wish to cancel ...simpleIt's not just about the money0 -
What am I missing here? It's an upgrade, so that means you were with Orange before. So what is wrong with your sim pre the upgrade?
If it is an Iphone, then I can see, but I have used the original sim after upgrading before now.0 -
spoke to orange and they cannot send out another sim card, yes we done it as a upgrade and the lady from mobiles.co.uk said it had gone through on orange but orange has no record of it, according to mobiles.co.uk we have to send it back to them and start again or cancel which i will be doing the latter, for whatever reason i cannot use the exsisting sim card, i thought along the same lines as you but they still want it back
The reason i want as much information as possible is in case they try to pull a fast one and sign me up for 2 years or charge me for anything, i have now emailed them and said as they cant fulfil the contract the need to cancel any credit agreements and treat the contract as if it wasnt made, and asked when their courier will be able to collect the items
Will now be looking for a new deal from another supplier0 -
Something odd then as i have never used the new sim card when i upgrade, just put the old one in the new phone0

Well it took some courage to get the contracts after reading everything on here.
I used them to get one contract in April and got first cashback. Then I have a second contract started in November - phone faulty in 14 days, got an exchange. And bro has a phone with them now as well.
See how it goes in future I guess. I had avoided CPW for 4 years (last experience was a memory of long phone calls) but given phones4u offers are not as good at the moment, they were next best option (for me).0 -

Lets be honest about them they probably are the worst 3rd party retailer to deal with and a typical "stack em high sell em cheap" operation and if it wasn't for the prices they wouldn't be able to sell phones.
So out of two contracts only one was 100% clean as the other was a faulty phone so a 50% success rate ???

By the sounds of it, this is down to orange and they do send out replacement sim cards for upgrades,
Its just annoying that i have the phone here and the gift i wanted but have to send it back to them, it doesnt make sense in my eyes from a business perspective but as said they have 1500customers a day so i guess i am one of the unlucky ones that they can afford to lose because I wont be using them again, and this is purely down to the customer service i have recieved from calling them and the fact i havent had a stright answer as to why i did not recieve the sim card nor has the upgrade gone through.
I have spent over an hour and 30 mins to them in the past week which is very tiring when iam just being told to send it back and cancel it,0
