Promised cashback not forthcoming - what can I do?

Hi all,

Back in Sept I ordered and received a new mobile from a company that included a 'guaranteed cashback' payment of £155 when I sent in my first bill etc.

This I duly did in October. I didn't receive anything for a month and then started ringing the careline. I got different answers from two different people at the time, but basically they said it had been approved and sent out on 20th October. After 10 days, still nothing. I then sent an email asking what was happening and was told that their accounts system had crashed on the 20th Oct, funnily enough when my cheque was approved and that no cheques could be sent. I don't understand this at all, how come no one can put pen to paper and write it out???????????

Two further emails later and I am now receiving replies from apparently the supervisor to whom complaints are sent to. She informed me that their system has now been sorted and that cheques will be sorted asap. This was over a week ago now and still nothing.I have emailed the supervisor again but as yet no reply.

I am really worried now that this 'guaranteed cashback' is not going to ever arrive. I only requested this phone because of the cashback and I need the money.

Can anyone advise on how I can sort this out? I think I'm banging my head against a brick wall with this company now. Who could I go to for further advice?

    surely its a breech of the terms that you agreed to. if you did everything they asked then they would be at fault.

    you could possibly has case to threaten to cancel

    Hi dazza,

    Its the phone supplier that promised the cashback not the network so cancelling the phone is not an option to use. I used the same company that I had used in the past, didn't have any problems then but it wasn't cash involved that time, just a gift.

    I'm wondering if this is a sign that maybe the company is in financial trouble, what with the times etc.

    It will help to answer your issue better and also warn others that this merchant is messing about and can be avoided if wanted.

    Well, following my email sent to the supervisor again this morning asking for the details of the 'person in charge', I have now received a 'cashback confirmation' email which basically says they have now received my redemption certificate and will process it within the next 14 days. I shall wait and see again.

    Strange that!! Especially as I was told it was approved on 20/10.

    The company in question is Beepy mobiles.

    Assuming they haven't gone to the wall - and do check that - then keep the paperwork you have admitting that they owe you money and "cheque is in the post" then send them an immediate LBA (letter before action) giving them 10 days to send you a cheque otherwise you will start a MCOL action against the,

    Then go through with it.

    They are probably in financial trobule and you need to get in fast to get your payment. You have already wasted too many weeks.

    Read up on Mobilejunkie's cashback for dummies thread and take swift action. They are clearly stalling.

    Almost certainly a bad omen. Most of the places that fold start by delating payments, I had it with Cool New Mobile, lots of delays then they folded.

    Agreed. You have no choice at the point. You must do a letter before action, and carry it out. If the company is going down you need to secure your payment prior to any trouble is made public.
    Although no trees were harmed during the creation of this post, a large number of electrons were greatly inconvenienced.

    Thankyou for your replies, how exactly should I word it, are there any templates I can follow please? What does MCOL stand for btw?

    Their website is still up and running so how do I check they haven't 'gone to the wall'?

    i've just tried to find beepy mobiles at companies house & i can't find them listed so it's probably a trading name, but they should have this info on their website & i can't find it...

    edit: found it, they're part of Shebang Distribution, credit gate shows they've had new directors appointed recently, no striking off action or anything else showing. perhaps others know a better way of checking?
