Actually just realised that there are a few franchises in department stores, but the majority of GAME stores(over 500) aren't franchises.

The website is different as it comes under the distance selling regulations where you have a statutory right to a cooling off period.

If the item was bought in a store then you have no rights to return for non-faulty items unless they have an advertised store policy which states that they do.

As what Sare suggests is fraud I am not sure that it is really an appropriate suggestion

No it won't be clasified as software, software are things such as games etc that are installed etc onto hardware.

As others have said in regards to the law, you do not have any rights, but if I were you I would appeal to their better nature and see what you can do to get a refund.

Where did you bring the xbox system? You say you brought it but do not specify the location that you actually brought it to. How can anyone help you if you don't even know yourself?!

grex you must be bored.why not try the thread on the Christmas board "Whats your elf name" .Let us know the results.:D
  • Can the person that bought the xbox for himself without knowing he was getting one as a present maybe be told the problem and use his receipt to return it (if he has bought it from somewhere it can be returned to). If he has opened his he could always return your one. As a last resort obviously but good luck with returning it to game as this would obviously be better.

I am bored actually! My elf name is "Booty Fruit Cake" :)

I'm still waiting to find out where the OP brought the xbox to. Maybe if I ask nicely, they'll bring me one. What do you think?

Whoever said return the item as faulty needs slapping.
I have NEVER returned a TOMTOM to Staples claiming it was faulty because Argos were having a promotion. Shame on you.

I know what I said is fraud, but I also know I'd do it if I had "lost" £300 on something I wouldn't use.
Game have thousands of pounds worth of stock returned every day, under their 10 day return policy and all that happens is it goes back to warehouse, re-packaged and sent back out.I know that morally it's wrong, but it happens.
