She said "My adverts do not state 'currently available' my adverts state 'we are always happy to hear from *insert job title here* with the following skills for this type of company.' "

That does not break any guidelines, and as it's in the wondow of an Employment Agency, it is clearly an invitation to register your details, and not a specific job.

How does that not answer your question?

In My town some of them do say "we are happy to hear from" Many others will say *insert job title *required. indicating that it appears to be an immediate opening which is misleading. As mentioned previously there are loopholes around it which would make it difficult fo prosecute an agency .When going into enquire and to reiterate again, they will say either

    1) The jobs on hold
    2) We have an indication from this client that they are likely to recruit very soon.
    3) The position has been filled and we've forgotten to take it down.

You can dress this up as much as you like but at the time of actual applying they are Fake jobs.

I have never personally seen a vacancy advertised through a agency that stipulates that the job won't be starting until a certain date, they are made to look like that its a start straight away.

Employers will recruit until they have enough suitable candidates to choose from. As there are currently hundreds of applicants for even the most menial post, it takes a great deal of time to go through them, screen, interview, train, and trial. Job ads therefore may either reflect the employer's preferred start date, or they may be open dated. In addition to which, the majority of job boards RC's use insist that a start date is specified when posting the ad. If the date is not known, or is ongoing as explained above, the current/ most recent date is entered. This is not misleading or deceitful, it's just how things are.

These things generally ARE above board Lily. You may view them as underhand, but that does not mean that is the case.

    "Generally" indeed.

Right, the following is in response to SK's comments but could be aimed at any RC who advertises roles that are not currently available but could be in the future.

I asked SK when she would advise her candidates that a vacancy they were enquiring about was not an actual vacancy but an example of might be required in the future. She got angry and refused to answer. This makes things look underhand.

If an agent is not duping a candidate or being underhand, then there should be no reason that they are not told STRAIGHT AWAY that the particular vacancy they are enquiring about is not current.

Even if the candidate has not read the advert correctly, surely you (or any RC) would correct them immediately and tell them it is not a live vacancy?

I would like to state for the record that I haven't once got angry in this thread despite lots of provocation.

I didn't say I didn't correct them. Again, you're putting words in mouths. I refuse to justify myself to someone who is nothing more than a blatant troublecauser.

The OP has issues. Anyone can see that.

    No need to justify yourself.

Should clothes stores not have mannequins in the windows?

If candidates apply for a job which they subsequently find is not available, they have the option of not using the agency again.

To be fair this happens with non agency jobs these days too - not that I would defend agencies for one moment. Avoid them like the plague if you can!

You seem to missing the point here, We have no option BUT to use agencies, If I say to myself that I want to avoid them then I'll struggle to find work, this is the main problem with agencies and they know how the economy is at the moment so they take advantage of peoples misgivings, Its easy to say you don't want to work for a actual company but you don't have that option with agencies, They could have a umbrella of about 20 company's that they seek candidates for.
