If a person parked on a yellow line but the warden mis-wrote a ticket, there's no denying they parked on a yellow line. The contravention did indeed occur, although may not be enforceable if the authority can't trace the driver or the driver (if traced) had the case thrown out on a technicality or "procedural impropriety". There is a difference.
The registration POO2 ABC does not exist in the UK, but anyone with knowledge of DVLA registration formats who reads the ticket would interpret it as PO02 ABC and trace the keeper from that. Once traced, (and remember that POO2 ABC would not be traceable at all) any enforcing court or adjudicator is likely (not certain, but likely) to dismiss an appeal on the grounds that the attempt to invalidate a ticket by splitting hairs over 0 and O is de minimis. A bigger mistake or omission, such as substituting a G for a Z, would throw reasonable doubt over the identity of the keeper, so is more likely to result in a dismissal as the contravention cannot be reasonably proven against that person.
It's like the parking adjudicator's decision that the absence of a termination T bar on a yellow line should not invalidate the presence of the yellow line itself as any 'normal person' would know what the yellow line should mean and should not park there. The trifling T-bar question was dismissed as de minimis and the appeal rejected.
I appreciate the 'de minimis' approach and agree it applies to many instances, but registration numbers are different.
Once the text is on the PCN it cannot be altered and the PCN cannot be cancelled and reissued. Therefore it cannot be tweaked because someone reading it thinks it looks like something else. The PCN should actually be binned - someone at the council is being naughty altering the reg numbers on PCNs because they think a character should be a zero.
It's not about the contravention being proved against a person ie. it's not an identity issue. The PCN has to state the precise nature of the contravention and the reg number can't be altered so that it reaches what the council presumes is the correct keeper.The contravention did indeed occur

I have no enemy imaginary or real. An enemy needs to stand, fight, show courage, and strength. The industry you support has non of these attributes, they would rather attack the weakest and meekest.
If you feel comfortable with the way you have attained any wealth you have, then so be it. No one here can change your beliefs. However most of the posters here have lost nothing to the industry you support because we have not fallen for the threats and intimidation.
However most of us have been shocked and saddened by the stories posted here of vulnerable people being hit with unwarranted charges.
Getting back to the thread avoidance on a technicality whatever your, or my thoughts is valid. Given that the industry you support thrives off attempting to charge people for technicality's at every opportunity.0 -
