Hi all,
I recently had a baby, less than 12 hours after her birth a photographer came round the ward and photographed her, i was told the pics would be posted out to me and had to sign a "consent" form for the taking of the photos.
Now they arrived last monday and i dont want them, they want over £50 which i wasnt told about by the photographer (she said something about a tenner). I contacted them and asked how to return, they gave an address. It was only when i advised due to horrendous snow in my part of the country i couldnt get to a PO they emailed back to advise i must send with proof of posting.
i can get to a post box but get the distinct feeling they will claim non receipt if i send like this. I cant get to post office. i have a 2 week old baby and the snow is over 30 cm here. the post office is 5 miles away and theres no way im walking ten miles with my baby.
can anybody advise me as i dont want to get saddled with £50 for photos i dont want.
the "consent form" says
no money is payable in advance but i agree to pay for any photographs that i wish to keep within 14 days
i agree that any items not purchased will be returned within 14 days free of charge.
please help. thanks

Get your partner to go to the post office for you.I was born too late, into a world that doesn't care
Oh I wish I was a punk rocker with flowers in my hair0 -
OP may not have a partner
As there's an e-mail route of communication I would e-mail them back, explaining that you fully intend to return the photos but are unable to do so...after all we have plenty of news items saying not to travel unless essential! Also tell them that you were unaware of this charge. I assume you've checked your copy of the consent form and that it doesn't mention £50 there? If it does it makes it a bit trickier but you can still make it clear you weren't told of the charge and that due to having only recently given birth etc you weren't in suitable state to read all small print0 -
i have a partner, who is in a wheelchair.
and no there is nothing about any charges on the slip i signed. thanks0 -
Why on earth did the company not just send you a few small example photos and an order form, just like pretty much all school photographers do these days?
It sounds like a rip off to me, and for peace of mind I would obtain proof of postage when eventaully the big melt comes and you can get around to a trip out to the local PO.0 -
i know they sent tons of pictures, page after page of wallet size, desk size,a4,calendars etc. total waste of rescources let alone anything else.
im just concerned they are going to charge me after next monday if i cant get them back. I have emailed them last week and advised i cant get out but they arent even replying now.0 -
If you can get to a post box, write a letter stating that you do not want the items but you cannot return them with proof of postage because you cannot get to a Post Office due to the weather. State that you will NOT be requiring any items and you will not be paying any money to return them as it is not your fault that you cannot return them in time. If possible, send a copy of any emails that you have sent/received and keep a copy of any letters that you send. These photographers are an absolute menace in hospitals, they prey on you when you are vunerable and you will sign anything. If you get any grief, state that you were not of sound mind when you signed the "contract" as you had just had major surgery (they won't be able to check so don't worry!) and you were still under the influence of the anaesthetic!"I may be many things but not being indiscreet isn't one of them"0

will i be liable for them if i just put them in the postbox and they say they didnt get them? im actually debating just buying them as i feel really uneasy about sending them back incase i end up having to pay anyway and get nothing for it.0

I wouldn't worry too much, if the form you signed did not state that you agree to pay £50 for the photo then the photographer cannot tack on her own price and if it came to a court case she would also have to explain what she was doing trying to make a woman who had just given birth sign a contract.0

its not the photographer personally thats charging, its a huge company.
im starting to get really nervous about having these in the house, weve still got over 30 cm of snow laid on the ground here,0
