Leaving work - claiming JSA

    I did not originally intend to give my notice in yesterday. I was hoping to find another job first but ended up having a row with my manager and decided not to wait. Basically I have worked weekends (as well as 3 week days) for over 3 years and am simply sick and tired of it. My husband works Monday to Friday and then I work weekends. He works long hours, sometimes not getting home until 9/9.30pm so we hardly see each other and have no real life together. We rarely go out together. I am the only one at work who has to work every weekend and I have said I am willing to work alternate weekends but was told no. The final straw yesterday was when I asked for 2 weeks holiday next year to be told no because on 1 of the Saturdays I want off another person is off!!! I just decided enough was enough and if I gave my notice in at least I would not have to work Boxing Day, the Bank Holiday Monday, the Bank Holiday Tuesday, New Years Day, the Sunday after New Year and the Bank Holiday Monday, all days that my husband will be off.

    My life and my marriage are more important than any job and I feel over 3 years as the only member of staff having to work every weekend is a joke.

    I think you may have a claim for constructive dismissal. Presumably you have your last contract of employment which will details your duties.

    I would get advice about constructive dismissal. If you don't have someone to talk to and can afford it, Which ? has an annual legal service for around £60/80 with immediate access to lawyers.

    You have bent over backwards and they have treated you like dirt on the information given.

    I'd sue their backsides off !
  • just a small point, but any sanction will run from a date AFTER the decision is made,not the date of claim, so benefit can be put into payment while all the paperwork about reason for leaving goes off to be considered, once the decision is made it will usually start from the beginning of the next benefit week. With any luck the op will have found another job by then.
