Police Section 5 DA04 - Accused of spitting at clamping officer

There may be explanatory notes available on the Oz immigration site. However, my view is that charged means formally charged. You have not been charged and even the receipt of a summon does not amount to the same thing in law. You have not yet even been summonsed and so your honest answer to the question is "No".My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016).

I don't understand how I can be issued with this notice, but when I've been assaulted and received threats to kill by two very well built 40 year olds, and called 999, the Police still put it down as a 'civil' dispute and won't look into it.
Thanks for all the advice up until now, if anyone has anymore I'd appreciate it
Have you thought of getting some external cctv fitted to your house ? and a personal dictaphone ? that way if they do threaten or assault you in any way shape or form you will have hard evidence from either source that you are being targeted by these scumbags, leaving the way open for you to the report it as a criminal matter to the police every time it happens. You may click thanks if you found my advice useful0 -
You might also think about getting one of these mini video cameras. They're inexpensive, have a pen-type pocket clip and will record for approx. 3 hours before overwriting. Hiya, I was just wondering if this has been sorted yet or is it still ongoing?0

try sending a pm.I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.0

Perhaps it would be worth considering contacting your local press about this? I mean they surely can't just make wild accusation without any proof or can they? I totally feel for you and wouldn't let this one rest and just swallow it either.0

If they have evidence to support it then yes.0 -

It's still on-going, but the Police cannot locate the original ticket they issued me, and they have not sent it to the main central office which deals with these tickets, so I have around 2 months to wait before it's officially ended. But between now and then, they can try and find it, and then I would appeal it in court. If they have evidence to support it then yes.
I was issued the ticket purely based on her word, there was no evidence apart from those who witnessed the incident and informed the Police the clamper had made false claims.Perhaps it would be worth considering contacting your local press about this? The press were much more interested in reporting about how I have been accused of spitting, and did make myself look quite bad.
I really do want to take this further and see her face justice for lying to the Police and making false claims, but unsure how I could do this.0
