    I do apologise if my blunt language can seem abrasive at times spangly, - regulars are used to me - i dont beat about the bush as you can see... i wont retract my message, but will acknowledge i could have been a prettier with the language....

    Edit: Now I get it: edited their posts due to "intimidation" aka not wanting to hear a diverging view. How childish.

    Good morning clutton, thanks for your frank response....
    I'm not complaining. Just asking if it is legal to deduct an amount from my deposit without my authority, for something that happened 3 years ago, and for which I have seen no invoice. And which would not have happened at all if they had repaired it in a timely fashion, thus avoiding injury....
    Spandangly, as you moved in to the property in Dec 2007 your tenancy deposit should have been scheme registered
    (if property in Eng/Wales) and the scheme's prescribed info passed to you by the LL/LA. If you feel you have valid grounds to challenge the LA's proposed deductions then do so, either via the scheme's arbitration set up (if applicable) or via the small claims court.

    You have to return the property in the same condition as when let to you, save for fair wear and tear and the LL /LA has to be able to show that any dirt/damage etc is down to your acts or omissions. I can understand that you would want to secure a floorboard that had already caused a number of trips but to do so without first checking for pipework/wiring etc was always going to run the risk of a billable repairs issue heading your way. You can challenge them on the actual costs - ask for evidence - and you should challenge them on the other 25 quid. LLs/LAs cannot unilaterally announce a deduction - they must get the Ts agreement.

    but this has made me realise that i need to check out the number of posts folks have written before replying, as sometimes i can come across as unintentionally abrasive.... thanks spangly ....

    The abrasiveness of your previous gloat post can hardly be described as "unintentional"

    Sometimes you can be somewhat quick to be anti-tenant. I know you well enough to know you're OK really - but it can come across pretty confrontationally if you're a non-native around these parts at times. Yeah there are people on here who take the mickey with some of the stuff they expect done in rented property and the like, and I've got personal hates I hate being thrown into stuff - but there are also sometimes when the fault IS on the landlord/numpty letting agency's side as well - and it can be an utter stressful misery if you've got an amateur accidental landlord reluctant to do repairs (been there, done that, have the worry lines to prove it) because you sit and pray that nothing's going to go wrong and not be fixed and it wears you down over time.

    I recall the original post before it was nuked and yep, I'd have expected to foot the bill for a nail going through a pipe - indeed when my dear husband drilled through a cable - we paid out and got it fixed ourselves because it was our mistake pure and simple. Husband now incidentally is banned from all power tools as a result of that - and when we get the keys for our new house I'm advance booking him into A+E because he IS that accident prone.

    Hopefully that comes across as intended :) Hell, this place has been a godsend for us in terms of dealing with cruddy letting agencies with a selective memory toward tenancy law trying it on, and getting through the house purchase maze - I actually almost know what all the bits the solicitors billed us for MEAN thanks to people on here :)
