Those links are very helpful, thanks - in particular, the part about sellers who think that stating signed for items cannot be refunded is correct. The seller has not been in touch, and I will be waiting until I can escalate next week. Thanks for the advice all. I'll update when I'm going through the escalation procedure. On my own understanding of what is the common view in this thread of some of your rights it may an idea to check the dispute at least include:
Goods Declared Faulty; Goods rejected; You require full refund entitled under DSR; You require the seller to pay return postage.
If I missed something hopefully someone will add to check list and my own understanding of the common view in this thread is you do not get return postage but you can ask.0 -

I bought an item from ebay .The item was new and buy it now. It arrived with a hole in the sleeve so I want to return it.
The thing is I can't get a reply from the seller. The item arrived on the 10th of this month.
I still have it ..What do I do next ...Just return it and hope they pay me back or keep sending messages?0 -

Go into paypal, find the transaction and open a chargeback for item signifcantly not as described (SNAD). Paypal will almost certainly find in your favour, and when they tell you to you need to return the item , fully tracked to the seller.
Unfortunately despite all the links above there is no mechanism on ebay or paypal to recover your costs in returning the item but if seller does not pay them then consider your feedback as appropriate once you have a full refund.

The seller is now playing nice, asking if we can resolve it with a partial refund, and saying that he will be out of pocket if he offers more than £17 - presumably, as a business, they must be prepared to issue refunds from time to time and have appropriate postal insurance. Take the £17.00 at the end of the day its a crack that can be covered and the cage still used, so i don't think that its unreasonable. I think its getting a bit childish, lets hold out for another three quid type thing.0

I am also a business seller on Ebay and am shocked at the rudeness/unprofessionalism of your seller!
As a business, sometimes you are out of pocket - it is part of being in business.
And the whole - 'we are being reasonable, even though you ignored our illegal and nonsensical rule' is bordering on aggressive.
Thankfully for you (but not always for good sellers!) Ebay/Paypal will be firmly on your side!
Good luck with it - but I am sure you will get your money back.

personally if i bought something for £43.99 plus postage and it was cracked i wouldnt be happy. who's to say that it wasnt cracked when they packed it..
If you ordered this from a high street store, would you keep it? i wouldnt..
Also has the seller had problems before, and is treading thin ice with ebay?
stick to your guns... full refund....and return postage...
or just ask them to send you another one.. and once you recieve the new undamaged one, you will return the damaged one...
please dont except £17... just because he said he will be out of pocket.... that business for you, you got to take the good and the bad....Work to live= not live to work0 -
Hold out for a full refund, the seller can try to claim the money back from the delivery company for damaged during transit.0
