Problems with DVLA

I got a fine through from the DVLA because someone had seen my car on the road, it was stationary and parked at my mechanics
( friend )house for a new clutch.

The DVLA said I hadn't SORNed it which i had and I sent them the proof. The car has been on my private land since Feb unused because I couldn't afford to get the clutch done. Anyway with winter approaching and it getting colder I got the money together and got the car over to my mechanic. He lives in a terrace with no off street parking so I put it in a small car park near the beach for him to work on.

The DVLA are now accepting I did SORN the car but now say it doesn't matter because to transport the car to the mechanic was wrong as I didn't have an Excise licence ?

Does anyone know what this is and how is the layman supposed to know this. The amount they are demanding is far in excess of any supposed offence and I need to know where I stand.

Any help appreciated cos at the moment it feels like the DVLA are licensed robbers and are just out to get as much money as possible.

When a car is on SORN it can not be on public land. Also to move it to your friends you would need to move it on a trailer. By parking it on public land it should have had a valid tax disc displayed.

They may nw believe that the SORN was a lie and are charging you all the back tax plus any 'extras' from the last time it was taxed.

When did the tax run out and what is the amount demanded?

See this http://www.direct.gov.uk/en/Motoring/OwningAVehicle/UntaxedVehicle/DG_4022059 £80 plus new tax disc or for a false SORN declaration up to £5000 fine and imprisionment.

Tell them it was moved on trade plates or trailered......

This is what I hate with the DVLA, once they issue a fine they won't give up trying to find reasons to fine you. You have a good reason so they land something else on you until eventually you have to pay.......

They are complete and utter scum.

Sounds like you took a gamble getting the car to the mechanic (was it insured?), leaving it in a public place and got caught.
Love it or hate it, road tax is something law abiding motorists have to pay. Sorry, but it should not have been on the roads in that state.

    Thanks for replying.

The car was untaxed from the beginning of February when it was SORNed. They are wanting the tax I guess from that date but I have provided proof that it was SORNed at that time so they can't carry on arguing it wasn't.( I sent copies of the internet declarations with dates / times etc. )

My issue now is that they are still claiming £172 because they say I should have had an excise license to move the car, but they don't know how the car was moved, they don't know I didn't deliver it on a trailer or in my horse lorry. Also is it not unrealistic to expect a car with a broken clutch to be driven anywhere ?

Thats all well and good if you can get away with it but it was on public land to be repaired.

    You're all heart.

It wasn't on the roads being driven around it was parked for the mechanic to fix the clutch on one day only.

...even if it's only parked on public land, a road fund licence (i.e tax disc) is required.

Is the car park public or private land?

I'm assuming it was public otherwise I wouldn't have been reported. They haven't sent me any kind of proof I was seen ie ticket or notice just got a letter out the blue.

As you said yourself they are a bunch of robbers out to fine you. Do you honestly think they checked or were honest about the ownership status of the car park you used.

Check and if it turns out to be private then (assuming you trailered the car there) it's been off road the whole time and no money is owed.
