    I will do thankyou.

Would it be wrong to ask for proof that the car was seen, and do you know what an excise licence is ?

What annoys me is that I could get less of a fine in a court for punching someone or shoplifting never mind this. There are so many rules / regulations that people don't know about and the fines aren't in proportion to the so called offence. How many other places do you pay a fine before even being found guilty of something in a court of law.

    As I said legalised robbery.

I think personally, that with proof of the circumstances this could get thrown out of a court..... But the DVLA will send the bailiffs after you, to bully you into paying until it gets to court.

how do you prove it hasn't been driven around since feb? and how do you prove it was trailered to the car park - even if it was private property.

    Innocent until proven guilty.
  • Had your MOT expired? You are allowed to drive the car to have work carried out for an MOT without tax, but it must be insured. Not sure about it being parked in a car park though as it would normally be on the private land of the garage.

Check and if it turns out to be private then (assuming you trailered the car there) it's been off road the whole time and no money is owed.
Yes! Private land to trailer to private land.

If they disagree, it is they who are required to furnish proof of it being otherwise, not you.

    Sorry, it's your own fault.

A SORN is valid for a year, so you are saying, unless you contact them, that it will be off road for a year. You could have notified them the day before it was going in for repair and avoided the backdated charge but you gambled.....and lost
