  • I've actually completed 10 months of my 12 month tenancy. I am now eligible to give notice to leave within 2 months. I don't have the contract at hand so I'm not sure about the eviction notice, but I believe it's 1-2 months.

I'm just so afraid that if I do open up a case against them or press charges, and if the ball swings in their favour, I'm going to end up in more of a pickle than I am right now. It's so horribly unfair :(

you have a 12 month tenancy
so it would be 2 months notice after the 12 month period
    so thats into March/April

the fact is you are 3 packages ddown from 2 separate companies
    were the Amazon ones tracked?
if so the company are saying 3 items werent delivered and the courier company/RM are lying?
  • Sorry - my mistake. It's a 12 month tenancy, with a 10 month break clause. From what I remember, the 2 month period starts after I've completed 10 months. That means the bare minimum I would need to fulfill is 12 months.

  • The Amazon ones were tracked, but really stupidly.

It has this tracking information on the website:
8 Nov 2010 08:15:01 PM Off Nine Elms Lane, Vauxhall LONDON GB Delivered
8 Nov 2010 08:40:00 AM Off Nine Elms Lane, Vauxhall LONDON GB Out for delivery

And I received two conflicting reports for the signature obtained.
First they told me that someone had signed for it -- but the name was suspiciously close to my own. At the same time, when I asked them to send me a scan of the signature, they told me that they didn't have it any longer but that the driver recalled the porter accepting it on my behalf.

Also, note the time. 08h15 PM. That's a ridiculous time for a delivery isn't it? I didn't get any confirmation of this, but I suspect the above means that the driver checked out of the delivery HQ at 08h40 in the morning and checked back into the HQ at 08h15PM in the evening.

i would think the 08.15pm is either a mistake, or the time the driver returns to the depot and docks the data from the PDA unit they use
i take it you dont have 24 hour concierge service?
  • It actually is a 24 hour service. I queried whether anything was delivered that evening, but nothing was noted in their book. In fact, nothing addressed to me was noted in their book for that entire day.

sounds like a lax system tbh.
  • I agree. I think at the very least, perhaps a day or two before I leave the flat for good, I'll drop a flyer into each resident's mailbox warning them of this incident. It's not right at all that the managing company gets off scott free for this act of negligence, not to mention their downright threatening tone of hostility.

You could try your half hours free legal advice with a solicitor, armed with your paperwork?

Perhaps a PO box for future?

I really do sympathise with you - someone knows whats going on.

  • Thank you for sympathies. I do sincerely appreciate it.

Since this incident, I've been having all my packages delivered to my office (the bigger ones are a hassle having to lug back home on a train but it's the only option now). I will be sure try a solicitor. MoneyClaimOnline would've been one way to go with this but of course, if that were to fail, I'd be in a much bigger mess than I am right now.

Thanks for all your advice everybody :(
