Sold an item on ebay that CLEARLY stated what it was, but....

Ok thanks. I'm going to work out all the costs (ebay fee and paypals 20p + 3.4% fee) then see if he'd be willing to accept it.

I'm pretty sure you should be able to do a mutual cancellation and then you'd get your ebay fees back. Refund his money via paypal and you'll get the paypal fees back too.

In this situation, if you haven't sent the item, best just to refund and ask to cancel the transaction. You won't have to go to the expense of reclaiming it, and some buyers believe - though this is not always the case - that they have a right of cancellation on any eBay sale rather than only on business BIN sales. It's not worth antagonising the buyer when you can deal with it quickly and amicably.

I think you'd lose if a dispute was opened, since this is for an intangible item and E-Bay generally frowns on those.

Ok, thanks. I have no problems refunding him, I'm just trying to work out how to do it so i can get my fees back.
He'll also have to wait until the money has transferred from paypal to my bank, as I stupidly withdrew It before I was aware of a problem.

Also OP, how do you defend a paypal INR claim when you haven't posted anything.

Firstly, I was unaware I could not sell the item on ebay, so I have made a mistake there.

Secondly, I haven't got to defend a PayPal INR claim as no disputes have been made, I am working with the buyer for the best possible outcome.

Thirdly, Even If he was to INR, I have the Item to deliver as the buyer well knows, It Is him that can't receive It.

Fourthly and lastly, I've just been reading the PayPal buyer protection, and learnt that Intangible Items are not covered by PayPal buyer protection.

Yes, but eBay don't permit intangible items full stop.

I have seen people trying to sell these a number of times, and although I think they are transferable, unlike MMO game accounts, in-game currency and items, they still aren't supposed to be sold for the reasons you've outlined. There is no seller protection, no buyer protection and some companies license their software such that the person who acquires these points or whatever in-game doesn't own them and therefore can't legally sell them according to terms of use. In the case of the first two points, this is why eBay and Paypal don't like handling them. The third point is that they are liable in the eyes of the game companies too and therefore don't want to allow people to sell them. Of course they can't vet every listing, so things do slip through (people still buy and sell World of Warcraft accounts on eBay, and Blizzard will shut you down if they think you are buying and selling WoW stuff). But since it is against the rules you yourself have little comeback if the buyer reneges on the deal by claiming INR fraudulently, and he has little comeback if you send him duff codes or stuff that can get closed down by the game company tomorrow because it's breaking their EULA/ToS. So --- it's not a good idea to try and trade them in the first place.

All ways round, perhaps it's better to agree to withdraw from the sale and find another avenue to dispose of them.

I understand what you are saying, but as I genuinely didn't know I couldn't sell them (I assumed due to the sheer number of other items from the game) that It was allowed. I fully admit I assumed wrongly.
Like I said I am working with the guy to try and get his money back to him, I just want my fees back, then I won't sell the Item any more, as I don't want my ebay account shutdown.
