Question regarding cancelling a customised bed

My other half works in a bed shop and in September, they had a customer in who needed a bed customised (base raised, head and foot end lowered) she paid a deposit and now she has phoned saying she doesn't want it/need it anymore. The bed has just arrived, so has been built to their specification.

Does the company have to refund her deposit and be stuck with this bed that may or may not sell?

    If the customer has ordered a customised bed she cannot cancel. She has signed a contract.
    She must pay for the bed whether she wants it or not.

    Sue her if nesessary.

    Wouldn't it depend on the agreement she signed ?

    The terms and conditions should be stated there.

    Thank you for your replies, the boss doesn't know yet as the woman only phoned today and he wasn't in. He won't be finding out until tomorrow.

    I'm with McKneff on this one. The buyer has bought the bed.

    Obviously the bed has a value and of course you could try and resell it and bill her for the difference. But if she is being difficult about why bother helping out.

    That's fine, but it depends on the agreement - any shop worth it's salt would have an agreement which does not allow customised orders to be cancelled, but the fact the question has been placed here questions this. As the OP said, the boss is not in until today.There may be a valid reason why it's no longer required - the person it was bought for may be dead!

    Which doesn't change the contract since both parties that entered into it are still alive and kicking!

    WHY DO YOU HAVE TO BE SO RUDE! My response was blunt because the person posting it has been rude to me in the past.

    Where does it say that the person who ordered the bed wanted to use it? they may have bought it for someone else to use - stop jumping to conclusions.

    At the end of he day .......... it's night (sorry couldn't resist that) it's down to the agreement and the shopowners goodwill. What would we be advising the customer if they posted the question?

    We would be advising the Op if they were the customer the same advice - they have a contract they cannot get out of - its not that difficult to comprehend is it. Dead or not.

    Doesn't the company have policies and managers who understand them who could give advice?
