Agreed, but how do you prove the terms of that contract if it doesn't exist? For example the "contract" may state that you lose the deposit or have to pay the full amount upon cancellation - how how do you enforce it?0 -

If the parties involved cannot resolve the situation, ultimately a court of law may need to decide, on the balance of probabilities.0 -

Well now your changing track over what you originally arguing over - the fact of a contract. i believe you said because the OP never mentioned it that there was not one though subsequently now that we have said they dont need to say there was one you are now backtracking to claiming what was in that contract.
