Question regarding cancelling a customised bed

    Maybe the fact that they have paid a deposit on the bed already confirms a contract. Most sensible people on this forum would have realised that and not had to have it spelled out for them.

  • The OP's OH has no need to ask you to ask on an internet forum. Just look at the terms and conditions that you would ask anyone to agree to if they asked for a customised bed.
    If you haven't got it - please don't flaunt it. TIA.

    A contract does not have to be written a piece of paper. By paying a deposit the customer has entered into a contract with the seller.

    As Cyberbob said, the customer entered into a verbal contract.

    It is also perfectly common knowledge that customer items cannot just be "cancelled".

    I would just call the customer to arrange their payment and delivery, and let them know that customised items cannot me cancelled. Perhaps compromise and tell them they can pay 50% to cancel. Would they then be able to flog the bed to cover the other 50%??

    Why should i apologise? A contract has been formed for a customised bed and a deposit has been paid. I don't need to see it written to know that a contract has been formed unlike yourself.

    No it has not been mentioned - but any business that takes money as a deposit and orders a custom made item who hasn't had the customer agree to terms and conditions needs their processes and procedures looking at.

    I agree, but that is not the subject of this posting - the fact hat the question was asked in the first place brings an element of doubt - this does not sound like your normal chain retailer if they are customising beds for customers.


    I fully expect to a be an agreement which states that he customer has to pay in full for a cancelled order, particularly for a customised item, but we can't assume that.
