;38132468]Yeah the fact is i've already asked for the postage back.

What statute do I need to give them to PROVE they have to give it back to me?
Tell them under the Sale of Goods Act you are entitled to a full refund including all costs (eg postage) due to the item being faulty.

Read this about The Sale of Goods Act.

Read this about Distance Selling Regulations.
Page 35 of this document will tell you about other legislation.

As the item was faulty you are entitled to all postage costs, even the cost for you to send it back.
It's overclockers though so you will have to do it the hard way. Like you I sent back a faulty product, they returned it saying it wan't faulty and even charged my card again for £20 to send it back to me. Also like you I spent thousands with them over the years but since then thay have not had another penny from me.

Would it be best to begin a Section 75 claim then, rather than deal with them direct??

As now i've made myself appear to be a !!!!!!, out of principle I doubt these guys are going to refund me.

Never used a section 75 before m8 so can't really help you there.

Email them again and paste this into it,

If they are faulty
Where the goods are returned due to being faulty the consumer is entitled, under the Sale of Goods Act 1979 (as amended), to return the goods within a reasonable time after purchase and claim a full refund plus any other losses that have been incurred as a direct result of faulty goods being supplied, such as the costs of postage. Where faulty goods are returned the refurbishment charge, and/or delivery charges cannot be deducted from the consumers' refund.

Ask them to also refund the reasonable return postage to you.
At this stage you only really have the threat of going to the trading standards for their breach of your rights, but this is sometimes enough for them to give in as they now see you know what your talking about.

Don't post your order number.
• I've returned things to Overclockers and had them refund the full cost and pay for the postage back, no hassle or anything.
I'm still driving away and I'm sorry everyday,
I won't always love these selfish things.
