If you returned the item as faulty, they should give you the postage back, if you returned it under the DSR then you wouldn't get the postage back.

This is what I thought as well.

How can I prove this to them? As they are adamant they have the right to leave me out of pocket.

To think i've spent over £4000 with them over the course of 5 years.

Quoting paragraphs from the DSR hasn't helped.

I don't understand the intention of your post? I know it hasn't helped, as he is still refusing to refund my initial postage?

He means you are quoting the wrong thing at them, if you want bananas don't ask for grapes. There was no point bringing up the DSR as it's irrelevant to the situation.

Talk to them again saying the product was faulty, they have accepted this due to accepting the return so ask for your postage as they don't have the right to keep you out of pocket for their mistakes.

I knew that as I stated in the original post. I was assured by someone at University that distance selling regulations covered everything, not just a 7 day window to return an item for any reason.

What do I have to prove to this guy??

Odds are out of principle he won't refund me so can I just issue a charge back as I paid on credit card?

DSR are simply a right to cancel within a 7 day period from delivery of goods as you were unable to actually look at them in a shop. You have a faulty item, this is an entirely separate issue.

Get on the phone with them (if you can) and ask for your postage back, if they refuse ask to speak to their manager/supervisor.

No you can't "issue" a charge back. However, you could raise it as a s.75 CCA dispute.

Oh, and don't listen to people at University who haven't a clue what they are talking about.

There was no "intent". Quoting DSRs when it has absolutely no application has not helped your position as it sounds like you don't know what you are talking about.

Yeah the fact is i've already asked for the postage back.

What statute do I need to give them to PROVE they have to give it back to me?
