If you read PayPal Seller Protection terms the seller sounds eligible.

Now is there anything in the terms that means the seller cannot claim the money back?

Seller protection guards a seller against a paypal claim on the basis of non receipt. This claim appears to have been done through ebay, and since the OP could not prove delivery (which is what paypal also would have wanted) at the time of the claim he lost the claim.

Everything it was a try but the postal delay here is what has caused the OP problems.

I suspect this may be the intention.

I deleted some text from my previous posts without changing the meaning as these are areas I want to look at off-line.

I was unsure as to whether to ressurect this thread or start a new one, but as the saga continues, here I am.

Basically, I have heard nothing from eBay since my last post. Nothing. In 'My Cases', it states 'Appeal under review - Please wait for eBay to get back to you in 48-72 hours, by 4 November 2010'.

I want to think that this is a good thing, and that the confirmation that the item had been delivered will find its way into the appeal the longer it goes on. However, I'm concerned that this is somehow going to come back and bite me. I have been issued with a refund demand that states "Please note that if you do not reimburse the full amount to eBay, your eBay selling privileges may be restricted or removed."

I figured I'd wait until the appeal verdict to make the payment - which I am really obviously loathe to do as buyer has the item - in the belief that eBay would rightly rule in my favour. But the longer it goes on, the more nervous I become that eBay will turf me out without any warning, since they seem impervious to rational thought!

Should I sit tight? Or pay the refund?

Thanks, custardy. That's my instinct, too - I don't want to admit fault at all, though obviously I don't want eBay to think I can't follow rules either.

So is it usual for an appeal to run on for so long without a verdict? I find it weird that they give such a specific timeframe if they're not going to adhere to it. Especially when they said they'd consider the initial case in 48-72 hours, and came back with their verdict after 50 minutes...

Does the delivery show up on the RM site now? Canada Post should send the delivery info through to RM. It's not guaranteed and does not always happen but it might simplify your dealing with Ebay/Paypal if it is on the UK site.
  • Thanks for that martindow - great tip. RM has updated, and now states: Your item, posted on 09/10/10 with reference XXXXXXXXXXX was delivered in CANADA on 02/11/10.

Fingers crossed. Still kicking myself for not trying to stall the dispute/appeal for just a day or two - it all happened on 01/11/10!

Really hope you win this one! I'm keeping my fingers crossed for you.
