  • i was declined because i failed the habitual residency test, i havent signed up with a G.P yet as i dont have a national insurance number and am in the process of trying to get one, a few people have replied with income support being the best option but my partner is claiming JSA will this affect claiming for income support? and if so should she stop claiming job seekers??

    Hmm, the link doesn't work.
    Just google income support apply online, and choose the website that is .gov.uk and that shoudl take you there.

    I ave a dodgy H, so sometimes I will sound dead common, on occasion dead stupid and rarely, pig ignorant. Sometimes I may be these things, but I will always blame it on my dodgy H.

    Sorry, I'm a bit of a grumble weed today, no offence intended ... well it might be, but I'll be sorry.

    If your nationality is British and you were born here, why do you have to apply for a NI number? I thought these were issued at birth.

    Still don't understand. What happened to the NI number you were issed with at birth? They are not like a passport, that you have to renew every decade or so. If you are a British National then you will have an NI number. I suggest you give the full details of your date and place of birth to your local DWP office, and ask them to verify that you are entitled to British citizenship and all that goes with it.

  • i had someone check and they said i didnt have 1 and that this might have something todo with my mum not claiming any benifts for me after i was born, its all very confussing, i have just looked a there web-site what service would this be called?

    I have a feeling you are not entitled to benefits. My mother was born here and I was born in South Africa. I have been fortunate enough to be in work but from what I understand about the benefit system is that you would have had to have contributed towards it in the form of tax and national insurance. As this is not the state and you don't know what happened to your national insurance number then you probably have no claim to public resouces. By the way I am a British Citizen through my mother and applied for a national insurance number (had to have an interview for this), perhaps you should contact your social secuirty office and make an appointment. Take your parents birth certificates as well as yours with you. That may be one way of resolving your issue.

    Even though you are a british citizen you will only be entitled to public funds if you are habitually resident. And as you have been out the Uk for so long it is up to you to proove habitual residentcy. Unfortunately at the moment you have so few ties to the UK that it is difficult to actually proove that the UK is your centre of interest, and that you will not depart back to Cyprus at the first availble opportunity. When actioning the HRT the DWP will look at a wide range of factors such as how long you have been in the country, whether you own any property in this country, or have bought significant purchases which suggest your stay will be permanent (furniture, a car, a house etc), whether you have registered with a doctor, dentist, hold a bank account in this country, whether you have close family and friends in the UK, whether you belong to any clubs, societies in the UK. Even if you belong to the local library can help show that you are serious about living here long term. Oh and if you are renting a place to live - what is the length of your tenancy agreement? If you can give notice very quickly this will count against you. Where as holding a full 12 month tenancy agreement will suggest a level of permance.

    On the other hand if you still have ties to cyprus - friends, family, and property in Cyprus this will count against you, and suggest you may leave.

    If on balance you dont fulfil the majority of the above factors then you will not be viewed to be habitually resident. However just because you have been found not to be habitually resident at the moment does not mean that you will always not be so. Apply for a National Insuarance Number, register with a doctor, open a bank account, join your local library, show that you are looking for work in the UK. Then in 3 months time retake for the Habitual Residency test. At that time you should pass and therefore be able to claim JSA as a couple.

    You could of course appeal the original decision that you are not habitually resident but unless you have more evidence to proove that the UK is your centre of interest I would expect that the original decision would be upheld.
  • thanks ross01 4 that, i will go and get a bank acc, sign with the doctor make an appointment 4 the n.i number and even sign up 2 the libary and try again then, and hopefully it wont take too long 4 a job to come up, thanks agin evey1
