I think anyone would have trouble understanding "your" logic. I think I'll just leave it to the others, as I'm off to bed. Some of us have got jobs to go to in the morning.0

Using the actual words from the SOGA explain your logic.0

His logic is very understandable... Sale of Goods Act can act up to 6 years. A cinema system is expected to last fare more than 2 years, therefore if it broke down in the second year, it is likely to have been not of satisfactory quality from the start. The consumer should find a really independent expert, NOT one sent by Comet. Write to Comet and ask them if they agree to pay for expert test in the event if the independent expert finds the goods faulty. If they refuse- it will work against them in Small Claims Court. DO NOT GIVE AWAY your system to Comet before the problem is resolved!!! They will take it - then you will never prove that you are right!0 -
Care to share?
Certainly.
I had a problem with a Samsung television after 18 months and posted here. Olliesdad (I think I have that right) gave me the email address of a chap at Samsung who sorted the problem for me. I have simply PMd the OP with the name of the person's email and I shall assume they have folowed my advice.

That doesn't explain his logic at all, besides, if you actually read my earlier posts, you'd see that I've already said that if the OP paid for an inspection, indepedent or otherwise, which proved the item had an inherent fault then they'd be fully legally entitled to the reimbursment of that cost. His logic is very understandable... We had a similar problem but it was with a HP laptop, one of the DV7 series. It overheated majorly to the point where you would feel it THROUGH the laptop cushion and it would heat up the surface it was on.
I bought it in May last year and took it back in September this year. My OH said about the 2 year law thing and PC World gave us a £430 voucher as a goodwill gesture. We now have a Packard Bell laptop which is much better
Good luck!Wife and mother :jGrocery budget

The proof of the fault after a year is on the buyer. Once the independent inspection is done a report can be submitted to the supplier . As long as the report states that the fault is down to a manufacteror (sp) fault the supplier can then offer a few things.
1. A like for like replacement 9 without the fault , of simular age etc
2. Free repair of the fault by an independent party .
and the supplier should also refund the cost of the inspection.
How do I know this ? I have had both a 2 piece suit (argos) and a cooker ( replaced twice by ikea) replaced under the SOGA . im not gonna say it will be quick and easy fix because it wont be , Comet will pass the buck as much as they can.
http://www.consumerdirect.gov.uk/ has template letters . I suggest you use the first after a purchase one and send it direct to comet hq, by recorded delivery give them 14 days to answer and then if they dont follow it up . Keep all correspondence , names and times etc as you will need them to prove who you spoke to .
Persever with this they will do as much as they can to keep you at bay . If in doubt email comsumer direct . Do it before they are decommissioned by the governement .
