Need proper advice please on DLA

    i fully understand its about mobility and thats why we found it hard to take in when they didnt give it to my mum,she was mainly bed ridden for 2 years, couldnt breath, couldnt do much for herself and after so long of trying to claim in she was awarded it feb 2010, but it was to late my mum passed away in july this year and admitted into hospital in feb, her condition had got so bad that she was unable to do anything and encephalitis had taken hold.

    so yh i think she should of been awarded it earlier.

    the dwp put a joint claim in for esa which meant my partner was also added to the claim etc.
    and i ask anyone here, would you claim a benefit if you ended up 200 a month worse off. ( no )

    it was dwp and council who said dla would be the best option for me.
  • If you qualify for DLA you might be entitled to an additional premium in an ESA claim. DLA and ESA can be claimed together. If you are entitled to ESA and choose not to claim it in order to get more HB/CTB, it's not fraud but it is deprivation and HB/CTB can be reduced accordingly.

    i think thats what dwp are doing, as they told me to come off and make application to dla.

    so i think they will do a joint claim for both. i will have to wait
